Kinda dumb question, but if i'm fishing off the gulf coast, an issues with CHL? i don't think that we take the boat far enough out to be in international waters or anything, but is the inter coastal waterway possibly "federal property" since is it a venue of interstate commerce? can anyone see any issues that might get a person hung up for carrying on their boat in coastal waters?

Wonder if the Coast Guard would know if a CHL holder falls under Maritime Law??. Not a Dumb Question.

I was told by an Operations Officer on the Phone at Coast Guard Port Aransas, as Long as you have a CHL, you are authorized to Carry concealed out on your boat, in the Gulf and Intercoastal Waterways.

Could never get anyone on the Phones at Coast Guard Stations
Sabine Pass or Galveston.

I was actually going to ask this same question. I'm off on an all day deep sea boat out of Port Aransas in mid June, and was wondering about that.

I had thought about this same question in the Past, figuring you fell under Maritime Law, but, calling the Coast Guard settled that Question for me.
How much is an all day deep sea adventure?.

I just thought of Something, Out of Respect for the Captain of the Boat, will you be asking for Permission to Carry aboard his Boat?, if he doesn't have 30.06 posted?. That seems like it would be a touchy situation, you pay a man to take you out for a day, but not let him know your carrying.

I understand your point, but I pay the clerk at Wal Mart to shop there, but I dont ask the manager if its ok to carry. Keep it concealed, and it shouldnt be an issue. Just my opinion.

I agree with that. Just figured being a private boat even if used as a Business, would be a different situation.

If I remember correctly, you can't trespass on a vehicle, so a boat can't be legally posted 30.06.

I tend to agree. I actually did give the matter some thought, including which pistol I would carry (my 642 Airweight in a pocket holster) if I decided to do that. I look at it this way... I am paying him $200 (I'm bringing my son along). That makes me the customer, and unless he makes it clear to all coming aboard that he does not permit any firearms aboard his boat, the customer is always right. I will also be bringing along a sharp knife, and nobody will blink an eye about that because it's a fishing trip. The captain truly has nothing to fear from me anyway, which the state of Texas has already verified, so it shouldn't be an issue anyway. And who knows? If things went horribly wrong, he could turn out to be grateful that I had brought it along.

[ASIDE]The funny thing is that, if you went back and researched some of my earliest posts here, you would find that I was pretty obnoxious about ideas like insisting on disarming people who enter my home, etc., etc., etc. Today, I cringe at some of the things I wrote then. What can I say? I was wrong. You live and learn, and this site has turned out to be a veritable fountain of information.[/ASIDE]

In a situation where I'm off shore, I'd want to know if I could carry my AR-15. Due to the issues of pirates and drug dealers, I'd want more than my pistols.
I'd be guaranteed to be out-gunned in a situation like that.

Jim- I appreciate your thoughts and concerns. I think most of us recognize that there are severe consequences to breaking state and federal weapons laws. I reread my post and the others and I see people offering opinions and suggestions, but I don't construe any of it to be "legal advice." I hope others have the same take as me.

If one is not certain about legality, I would advise them to make sure they obtain competent legal advice before making decisions concerning the carrying and use of firearms. IMO, getting advice from an AG office, DPS or Coast Guard lawyer over the phone is a good idea, but I wouldn't count on getting a definitive answer to the questions posed in the OP. There are many portions of the law that are unclear or even contradictory. None of us wants to be in a court room trying to decide what is legal and what is not. Other forum members do as they see fit, but if I am in doubt, I don't carry.

We do have some forum members who are attorneys, LEOs and CHL instructors who are well-versed in some aspects of the law, but the best place to obtain legal advice is in your attorney's office not on an internet forum. As Charles Cotton sometimes says, "I am an attorney, but I am not your attorney."
