I picked up a new knife a few weeks ago cause I misplaced the one I have been carry. I got it from Acadmey and didn't notice that it was an illegal knife until I opened it cause it is Kershaw assited open.

But since I got lucky and found the mispalced knife this morning I will not be carrying the illegal knife an longer.

I don't see what the big deal is about having a switchblade. My Emerson CQC7 opens just as fast with some practice.

When originally outlawed it was viewed as an assassin's knife or a gangster's knife.

Different from your standard issue pocket knife? Not by much, agreed. Actually I'd prefer a pocket knife/SWA. Switchblades are generally flimsy pieces of garbage.

I agree with the flimsy piece of garbage bit. I find it funny though that I can carry a pistol just about anywhere, but a pocket knife is illegal. I guess it all goes back to gov't and the lack of common sense.

I can understand though. At the time it was a gang weapon.

I think there's probably worse public opinion for switchblades (gangs) than open carry (cowboys) in Texas.

How can stores and internet sell something that is illegal?

Do the stores think it is not illegal? Why is LE not raiding stores that are selling "illegal" AA knives?

Do Legislatures not know what it really is (as opposed to a switchblade)?

An assisted opening knife is not an illegal knife.

I agree! The current 'automatic' knives are the current equivalent of the switchblade and they are not normally sold to non-LE.

I have several of the Kershaw assisted opening knives. The smaller ones work ok, but my Boa opens like a slow motion video.

I do believe, though, that someone (Steve Rothstein???) did post a court case where a conviction resulted from an assisted opening knife.

I haven't seen the referenced bill, but would like to see knife carry clarified.

I would also like to see our current CHL change to a CWP....Concealed Weapon Permit. That would cover more than just a handgun.

They justify 46.02 and 46.03 by saying the Texas constitution allows the legislature to regulate bearing arms but how do they justify 46.05?

I've talked to several LEO about this. . . they all agreed that spring-assisted knives are legal as long as you are applying pressure directly to the blade when you press the lever.

I purchased a Kershaw assisted opening knife over a year ago and was concerned enough about the switch blade question that I wrote Kershaw and asked them about the legality. Kershaw replied that it was legal in Texas and a court case had found in Kershaw's favor that assisted opening is not the same as switch blade.
