Called a venue to find if they were 51% before going...

So, I'm traveling and meeting friends at a place called 3rd Base in down town Austin.

I call first and don't want to ask something that could be seen as adversarial, so I simply ask if they're a 51% location. I asked the guy who answered if they had the red 51% sign posted. He had no clue, so put a manager on. I was disappointed because I knew a manager would know why I was asking.

The manager responds, "We're not. We're just under 50%, but we post one anyway because we don't want guns in here." <--- :shock: :banghead:

So I then say, so you have a sign posted that is incorrect? He says, "Yes. We don't want them in here" (Them referring to guns I guess)

Now I know he's a complete idiot, and exemplifies what I really hate about this city and all liberal morons. I wanted badly to find out if there's a 30.06, but didn't bother asking. I don't want to educate him on how to effectively keep CHL's out.

I cannot carry there because I have now been told not to by the management, but what about others? If there's an inappropriately posted 51% sign, can TABC be notified and have them take it down?

If nothing else comes out of this thread, I hope it keeps more people from frequenting this establishment.

Geeze, what a maroon. Anyway, resist all temptation to educate him about proper signage. Just inform TABC that his establishment is incorrectly posted and request that they correct the issue. Maybe our tax dollars might be put to some good use.

Update: just stopped in to see the place. Something told me that he wasn't "all there" in my convsersation, so I wanted to see the 51% sign myself and also see the liquor license.

Well, no 51% sign anywhere. They had the "no carrying unlicensed..." sign, and the license is "sign=blue".
Now I only wish I hadn't called, but given the conversation with the moron manager, I don't want to spend my money there anyway.

Is telling a person over the phone that they don't want guns in their place actually effective oral notice? He may not want them, but he didn't tell you that you couldn't. And if you carried in there and somehow were discovered how would he prove that he told you anything? How would he even know that he had ever spoken to you at all?

I don't nor do I recommend calling ahead about a venue's 30.06 or 51% signage or their preference for or against patrons being armed. From what I read on this forum and elsewhere too many who do not have a CHL do not know the law...and many also lack some common sense. JMHO, YMMV.

I can generally guess from the nature of the establishment I'm thinking of going to if it might be legally restricted, and I'm prepared to lock it in the car if needed or give them a no guns = no money card and go elsewhere. And there's always texas3006.com to consult. :txflag:

99 times out of 100, I use the same thought process. My reasoning here was that it's a beautiful day out and wanted to walk. It's a long walk which is one of the reasons I really want my G32 with me, but I'd be in a sticky situation if I get there and can't carry inside. I'd have friends waiting on me inside and no car outside to secure my gun.

Cover it up under a "doing school research" or "probation for PI or alocohol and cannot go into 51%"

I actually thought about that. I almost asked more questions under the guise of doing research... especially being in Austin and all, but I didn't want to drag the conversation on further and give more attention to the whole situation.

I confirmed that the place is not 51%, and that there is no 51% sign, so it's "carry friendly" as far as I'm concerned.


To address the post above about "how would they know whether i was the guy on the phone"... well, my paranoid self started thinking about one of the worst case scenarios. If I had to use my weapon in self defense, it would create a lot of commotion, obviously, and the phone call would come up, guaranteed. Then if I tried to deny it, but somehow my phone or something was part of the evidence and the call was shown to the restaurant, I'd be shown as a liar which could hurt every other legal thing that may come up... crazy I know, but with something this serious, I don't want to take any chances.

Even if you consider this oral notice... I think that his notice could be deemed as expired. He told you that they have a 51% sign up because they don't want guns in there. When you went in, they do not actually have a 51% sign. So for all you know they had a change of heart about guns since they must have taken the sign down (if it were ever up in the first place).

I agree. Thanks for the thought. If I'm ever forced to go there, I'll be carrying.

This raises a good question:

How long is notice good for?
- That visit?
- End of day?
- Two weeks (like your Miranda rights. . . hahaha)?
- One calendar year?
- Eternity?

Don't you have a reasonable expectation that ownership, management, and policies can all change with time?

I usually view notification as valid for THAT visit only. The next time I visit, everything is reset (unless there is some sort of contract that specifies an amount of time for the notification).

What do you guys think? I've never seen anything in the statutes. Is this one of those gray areas left for juries to decide based on what they deem to be "reasonable"?
