Texas CHL issues

Ive been in Texas for less than a month now and having been a CHL holder in WA state for the last 4 years I was andstill am VERY excited to be here... But before i got here I had what I perceived as going to be an increase in my weapons freedoms etc... I mean this is TEXAS!!!

Uh, but in reading this forum, finding out after I got here how long it takes and what it takes to get the Texas CHL and learning the restrictions of where and when I can carry... I'm just wondering how so many restrictions happened...

I love it here but it seems like so many posts are about how to stay OUT of trouble and not get your butt in court as opposed to just enjoying the fact that you can exercise your 2nd amendment rights and your CHL ...

One thing you have to realize is that Washington State and Texas are two different planets. Washington is ultra-liberal. Texas is ultra-conservative. Realizing that is the key to understanding.

Welcome to Texas and the Forum. First of all I think that one of the reasons that Texas takes longer to issue the CHL is that the CHL program is run by the state, where in Washington the permits are issued locally. I am not sure what areas are more restricted in Texas vs. Washington. Maybe you can post some specifics that we can discuss.

One of the reasons that you read so many posts on how to stay out of trouble is that the Texas CHL Forum constantly has many newly minted CHL holders joining all of the time. Many of them want clarification or reassurance of what they learned in class or what they think they learned in class. There are also many posts on "the joy of carrying" when you get into discussions of guns, calibers, ammo, holsters, and belts.

Call your state rep and tell him/her to support
HB 681 and SB 750

Call your state senator and tell him/her to support
SB 354 and SB 321

Please don't take my post as a complaint or talking bad about Texas... As I said, I love it here the issue is I'm just surprised as to:
30.06
All the other (non enforceable) signs stating no weapons, CHLs etc...
As stated... the class, length of time and extent it takes to obtain the CHL and nah, the WA CHL is a state issued permit
And the length of discussions on the ways to not get in trouble for even accidentally showing that you're carrying
I was just a little surprised as to all the red tape and ppl trying to stop me from carrying 30.06 etc...
That's all.. Just making an observation.

Yeah, but most of our houses come with air conditioners... it was a tradeoff "rlol"

Edited to correct a typo ( I meant OUR Houses, not ouT Houses.... why did they put the T next to the R? :banghead: (most out houses do not have air conditioners, except in the rich part of town :lol: )

I don't see that Texas is more restrictive, based upon what little I can see on Handgunlaw.us

Schools (handguns):
Texas - can't go into buildings, buses, or activity grounds when school supported activity is on-going.
Washington - can't go on the premises (not narrowly defined like Texas), but a licensee can pick up or drop a child off at school. - More restrictive

Jails:
Texas - Off-limits
Washington - Off-limits

Law Enforcement Facilities:
Texas - Cannot prohibit armed CHL's from entering, but can require them to disarm and put handgun in lock box. Also, "law enforcement facility" is very narrowly defined.
Washington - Off-limits - More restrictive

Courtroom and offices:
Texas - Courtrooms and offices used by the court are off-limits.
Washington - "Those areas in any building which are used in connection with court proceedings, including courtrooms, jury rooms, judge's chambers, offices and areas used to conduct court business, waiting areas, and corridors adjacent to areas used in connection with court proceedings" are off-limits - More restrictive

Restricted areas of mental health facilities:
Texas - No provision.
Washington - Off-limits - More restrictive

Businesses that serve alcohol:
Texas - 51% locations off-limits to CHL's
Washington - All areas off-limits to persons under age 21 years are off-limits for licensees - More restrictive

Outdoor music festivals:
Texas - Legal
Washington - Illegal - More restrictive

Loaded rifle or shotgun in motor vehicle:
Texas - Legal
Washington - Illegal - More restrictive

I don't know how Washington handles trespass by a licensee, but don't know of any states that make it as hard to post property as off-limits to armed CHL's as does Texas. 30.06 signs are few and far between and signs that actually meet the requirements of TPC ยง30.06 are even fewer.

There may be other statutory provisions or case law that would change the this outline, but if so, they aren't listed on Handgunlaw.us. All this said, what I don't know about Washington gun laws would fill volumes.

Saw something browsing too looked like in WA day cares may be off limits
and unlicensed people with pistol in car must have it unloaded in WA
WA and Texas both have preemption of local/city laws

WA has a texas3006.com type site called friendorfoe.com for businesses which prohibit



But colleges .... no State law criminalizing, and one campus does not prohibit, but others, like Virginia Tech have campus "policy"

I wish, instead of letting antis get by with saying "only 2 stats "allow" we corrected them and said all but 23 States don't "prohibit." or even better ... WRONG !!! 27 States "ALLOW" Really, in my mind, if it isn't a crime in those majority of States ... they "allow" except a school's policy might not.

TWENTY-SEVEN States "allow" (I think) ... that's a majority. Or, in other words, it's perfectly legal in 27 States, why not Texas?

50 - 23=27 States allow it, we are behind the majority ...in the minority.


MOST States ALLOW Campus Carry by licensees ... (not a criminal offense)

John Woods and his parade use the "jump on the bandwagon" (only two allow) we should be using advocacy in wording and correcting his falsity.

In the year and a half that I've had my CHL I've seen four or five 30.06 signs. I think only two of those met the requirements and one of those was in a public school office where it would be just as illegal to carry without the sign. I just laugh at the gun buster signs because I never carry my Beretta 92 anyway.

Washington State a few years ago was 98% public land while Texas is 98% private land. My point is that you should expect vast differences. I'm sure there are many reasons which others will present: population, demographics, etc.

I sometimes wonder at how we got to where the whole country is now. I think the answer to that is the same as the short answer I would give to your question. Fear.

I was in the military got my CHL in washington state but I am a texas resident since i have been born. Do I have to get a whole new CHL for Texas or can I get in renewed in Texas.
