What is the defenition of a "racetrack" as far as the DPS and CHL are concerned? Racetracks are off limits to a CHLer according to penal code but do they have to be 30.06?

I am not a race fan, so I am asking a real question
Is this like Nascar or other? would that not be considered a "professional sporting event" if so?

Is anyone else worried about instructors who don't know the law? It seems there's a recent uptick. No offense to the OP or other instructors, and I give credit to those who try to find out the answers, but I worry that DPS isn't doing a good job teaching new instructors.

I have been there, but not during a racing event. It was not posted, and I carried. It was at a corporate Christmas party put on by one of my clients, and it was held in a banquet room in one of the trackside buildings. Neither the parking lot, the entrance, or the building were posted.

However, if there is a race going on—which is a professional sporting event—all bets are off.

This is why I stick to drag racing. If its a track night, not professional event...and you can bet most other drag guys are pretty 2A friendly as well....One of the car sites I'm on has its own dedicated gun subforum.

Ah, well there ya go. My fault for looking in section 46.03, the section with the actual restriction, and not checking the other sections around it!

The instructors I worry about are the ones who will make claims they are not sure about. I will qaulify to my class that I do not know everything, but I will do my best to find out. We only have ten hours of class time, which makes it impossible to cover everything. Mr Tom Estep told me once that we can only start a class, but it never ends.

A side note, the question came up about the ractrack in Baytown. I have been there and did not see a 30.06 sign but was not sure if it met the definition of a ractrack? If it is not a racetrack then it would surely fall under a sporting event, I would think?

Sporting event maybe, but is it a professional one? Do these people do this for a living and do they get paid?

Very sound advice. I wish all new CHL folks realized that the class is just a beginning. I know that I did and am quite thankful for the revelations I have found after class.

you know the deal I am NOT a lawyer, however as I understand it the Royal Purple facility in Baytown does NOT meet the definition of a Race track as the law sees it nor does it meet the Sporting event clause as it isn't an organized team event (not really how they are defining professional sporting event) but as far as I have been told and know that it doesn't meet the requirements as such. so unless otherwise posted carry away

I edited my original post, changing 46.02 to 46.01 for accuracy.
