What should I do?

I just got back from my grandparents farm in WV. I accidentally left one of my handguns there when we drove away Saturday. My Uncle grabbed it for me as he was still onsite. I live in TX and my uncle lives in MS. Can he just simply ship it to me through UPS or FedEX or do I need to go through an FFL? Any other considerations?

Thanks!

Todd

I think you could have legally shipped your guns home to yourself, but I don't think a family member may legally ship guns directly to you across state lines.

Either have him hold it 'till you see him again or he will need to have his ffl ship it to your ffl.

I have shipped a pistol to a gunsmith for repairs, etc using UPS air, and received it back, no FFLs at either end.

Personally I would just have him mail it but as me. He would be acting as my agent and I don't see any difference to having my kid or assistant filling out some labels or running a package to the PO than having him mail it. Mind you I don't know all the legalities but I have trouble seeing it coming back to bite me. Assuming it's a firearm that is on the books as yours anyway it only cost 10 or 15 thru a FFLo if it's a big concern then just go the FFL route.

6. May I lawfully ship a firearm to myself in a different State?
Any person may ship a firearm to himself or herself in the care of another person in the State where
he or she intends to hunt or engage in any othe
r lawful activity. The package should be addressed to
the owner “in the care of” the out
-
of
-
State resident. Upon reaching its destination, persons other than
the owner must not open the package or take possession of the firearm

IANAL...but here is what I would do.

Have your brother pack up the gun for shipment. It will have to go common carrier, not USPS. Create a call tag yourself online with the Ship from showing your name at the out of state address and the Ship to showing your name and your home address in TX (don't forget insurance) Email the label to your brother so that you he can apply it to the box. Per UPS rules it will have to go some form of Next Day Air. Call UPS and schedule a pick up from your brothers.

You are now shipping the firearm from yourself to yourself.

Again, I'm no lawyer.
