Unfortunately he fired in the air. Its worth clicking on the link to see how stupid you have to look to call the police after committing a felony.

In an attempt to escape after the attack, the victim grabbed a shotgun from his home and fired two rounds into the air, the sheriff said.

"Killingsworth and Moore took turns hitting the victim with the bat, causing extensive head, face and back injuries, the sheriff's office said."
One's judgement - and aim - might have been impaired by being hit in the head with a bat. Still, he's alive and the assailants are in the pokey. There have been worse outcomes.

Is it worth talking about that in most jurisdictions, you can't fire that gun in the air legally? Sure seems like aiming it more accurately would be legal and justified. Those guys were very lucky.
Maybe a shotgun is different because it'd be hard to claim that pellets coming down would be life-threatening injury?
