Road rage driver follows man home and is killed

No details on CHL, or whether the man was arrested. I will let the debate begin if it was a self defense shooting.

If you are being followed you do not go home.

Something is wrong here. How was he charged with murder when the guy followed him home? Has to be more that the press doesn't know yet.

Well there was the leaving the scene which always increases your chance of charges. I also wonder if he may have made statements to the cops which made it seem it was something besides self defense. You have the right to defend yourself but you can't shoot because someone did X Y or Z, you shoot to defend yourself and X Y or Z made you believe it was necessary. If you start telling the cops you shot someone because they chased you or yelled threats at you then you open yourself up to possibly being charged when if you say he chased me and threatened me and I felt I had to shoot to defend myself you are on firmer ground. One sounds more like you are mad that he violated your boundaries the other legitimate self defense. Mind you it can be the exact same incident and a person can just use different terms and buy themselves a charge.

Total speculation on my part though

IANAL but I believe you can not claim self defense if you are an instigator in the conflict ie: You start a fight, start losing and shoot the guy and then claim self defense.

Additionally IIRC self defense is an affirmative legal defense. Often it has to be proven in trial. Its not a get out of jail free card.

I just saw this comment on the Chronicle web site. It kind of makes sense about shooting someone:

"So once I got my CHL, I've been using the Shark Tank method. Would I jump into a shark tank to save a car stereo?..... Would I jump into a shark tank to save my son?.......Would I jump into a shark tank to save some I didn't know.??.. Would I jump into a shark tank just because the shark threaten to eat me?."

Another news website said that after pulling into his driveway, the shooter sent someone else inside the house to retrieve the gun. He then emptied the mag on the other driver (16 rounds), left the scene to dump the gun in a bayou before returning home and calling the police.

Yep that'll do it. If you're claiming self defense you don't act like you committed a crime.
