I saw this earlier and will repeat my thoughts here.
The suspected rapist was attempting to escape and not even inside the dwelling at the time the husband caught up and attacked him. This is why the husband was arrested and will have to see if DA decides to push for charges. Given the deceased had a lengthy arrest record for a multitude of violent crimes I would hope that the good people of NYC will decline to.
Just like here in Texas, if he is no longer a threat you cannot attack. If you do you will be charged and arrested. The cops did the right thing here and hopefully the DA will as well.
I am not at all making excuses for the deceased, but removing emotion from this and dealing only on details as we have them now you must agree.

Absent better information I'd agree with DevilDawg.
My spider senses tell me there's much more to the story.
The wife got away long enough to make a phone call in the middle of a rape? And the perp was still in the building? With the husband outside?
Fishy.

Mark Levin talked about the incident on his radio show this evening.
Dead guy has 17 convictions, including holding a young girl hostage in his basement for two days and raping her.
The wife and her sister were home. The BG entered the apartment building by following someone in. He proceeded to knock on doors. The woman on the sixth floor opened the door without looking as she thought it was her son. The bad guy barged in locked the door behind him and pulled down his pants and said the was going to rape them. The woman offered him money to leave, but he insisted he was going to rape them. They fought with him and at some point one of the woman was able to call the husband and tell him what was happening. He is a cabbie he rushed home and took the elevator to the sixth floor when he got off his wife was naked in the hallway with the man. He had previously ripped her clothes off. The BG is 40 the GG is 61, but he had a tire iron. (remember NY can't have a gun) They fought. The BG died. The GG told the police he was fighting for his life.
As Mark Levin pointed out he is not going to rape any more women.

Based on that, I would lean toward defense of a 3rd party since his wife was in the hallway with the bad guy. Of course, he may have knocked the guy down and proceeded to pound him into hamburger.
IMO, this does not appear to be a bad outcome. The only thing better would be if a whole bunch of neighbors rushed in and beat him to death. I don't know the details of NYC's self defense laws though. It ain't always about what is right, it is about what is legal. The two should be the same, but not always.

Without knowing more than this I agree. Learn toward defense of a 3rd. Still think there is more to the story, only time will tell.
I HOPE that if it did happen that way they let the GG go, considering the BG criminal history.

Just a thought. The story states they met in the hall. Did the rapist run towards him or did he run away from the husband? If he ran towards the husband wouldn't that be self defense?

We won't know that until they release further details.

Remember Bernard Goetz? Several guys with sharpened screwdrivers mugged him and he was still charged and branded a "vigilante" instead of being labelled "self defense". What many people in Texas don't realize is that in some states of the Union and most other countries in the world, there is a socialist mindset. There is no "self" in a socialist mindset. There is only "society". A criminal is like a bum knee. You don't cut off your bum knee because even though the knee is bad, it is still part of the whole person. In other words, you cannot kill a criminal because he is still part of society. That's why there is no such thing as self defense in a socialist society. That is the dark side of socialism, which they never bother to explain to the libtard voters who vote for socialists such as Obama.
States with a high proportion of welfare recipients have socialist mindsets in the populace; Commiefornia & New York.

Common sense and acknowledgment of the right to protect one's self and loved ones prevailed in NYC!
