Put this in self defense because it sounds like a good shoot. All though details of why the guy followed him and what words where exchanged.

There may be a problem with this being a "good shoot". A bystander was shot in the back. Depending on who shot the bystander, the person acting in self defense may have a problem.

Nowadays it would be unusual for there not to be.
