Need a Red Flag Law for Astronauts?

A NASA astronaut has been accused of committing the first crime in outer space after her estranged wife alleged she stole her identity and accessed her bank account without permission during a six-month mission aboard the International Space Station.

For all their testing, examinations and investigations, if NASA can't weed out a psycho from the active astronaut corps, how in the world does anyone think that a so called "red flag" gun confiscation law is going to work?

(Note: all accused astronauts are innocent until proven guilty in a court of law [wow, what a concept!])

I’ve know some women who had a lot of the same interests as me, hot cars and pretty women. I’ve never asked about guns, but I suspect they liked to hunt and shoot as well.

I’m sure they are all rolling their eyeballs right now and going, “oh great. First criminal in space is a woman and has a wife”.

Most of the comments on line seem to ask if adult diapers are involved.

To be honest it kind of looks like one wife is trying to make the other wife look bad by claiming she did something nefarious when she was simply checking the account they had always held together. In normal husband/wife relationships it is quite common for one to give the other passwords or access to accounts that are mutually held. I suppose it could be common in one of these "new modern relationships" as well. Technically I suppose, it could be considered illegal to access the account using the others password. Maybe even if it is verbally allowed for a period of time. It looks like even same sex marriages can devolve into a war.

I don't know that vetting would have made a difference in this situation. A divorce that becomes a war is not something they would be able to predict. From the article it looks like they were going through a bad divorce. It is no different than any spouse claiming the other did something illegal or bad.
I would be surprised that not at least some of the married folks on this very forum utilize access and passwords to each others accounts.

The astronaut wife claims she was checking bills, which makes sense.

From the above linked article.
McClain has denied these allegations, telling the inspector general’s office in an interview last week that she was acting in routine by checking the family’s finances to make sure they had sufficient funds to pay bills for their son.

Sounds like she had the account number and password to check the account and did it regularly before.

Doesn’t sound like she “hacked” the account.

Fairly easy to change your password when you become separated.

I wonder what state has jurisdiction for crimes committed aboard a space station? And since it is an international station, what country does?

I found this

https://www.oxfordscholarship.com/view/ ... chapter-15
The Legal Status of Astronauts * 1
Bin Cheng
DOI:10.1093/acprof:oso/9780198257301.003.0015
This chapter discusses the legal status of astronauts. Astronauts of whatever nationality are subject to the full jurisdiction (jurisfaction as well as jurisaction) of the territorial State, while they are within its territory, including its airspace, whether or not actually on board their spacecraft. In addition, they are subject to the quasi-territorial jurisdiction to prescribe (jurisfaction) of the State of registry (or launching State) of the space vehicle they are in, as well as the personal jurisfaction of their respective national States. As soon as a space vehicle leaves the airspace of the territorial State and reaches outer space, the astronauts on board come under the full jurisdiction of the State of registry, while remaining under the personal jurisfaction of their national States.

When the NASA shrink asked about her marriage, she said she needed some space.

If you are going to set on top of tons of highly combustible fuel while it is lit on fire, I think you a little nuts to begin with.

She had the boy before her same-sex marriage according to another news story.
