I doubt it was any malfunction of the gun at all. Look at the picture again. Apparently Mr. Thug forgot he engaged the safety.

Yes, the safety is still on in the pic. Hi-Points are inexpensive, ugly, heavy, and I don't like their engineering, but they are normally fully functional in the proper hands. Pointing one at cop should get the response that this one got.
