Look at your deed. The legal description of the property you own will be set out in full. If it says "Lot 123 of Blackacre according to Map thereof....." Then you probably do not have an interest in the common area as such, merely a membership that rubs with the land in an HOA corporation which owns the land.

OTOH, if, in addition to "Lot 123 etc, then describes an undivided 1/150th interest in described lots, or similar, the you likely do own an interest as tenants in common with other homeowners.

Condos and townhome developments are more likely to have these common areas.

This is why I will never live anywhere with a HOA and I am working my state reps to pass laws to curtail HOA unbridled power. :banghead:

Well my HOA just posted 30.06 and 30.7 signs leading into the tennis courts/playground area. The clubhouse and pool are not posted. I talked to the HOA President (CHL Holder) and he said they wanted to stop OC but were concerned about people going to the pool and leaving guns unattended. They are going to revisit this decision at the June meeting. I will be there to politely try and let them see the error in their ways.

I live in North Dallas and thus far it has not come up in any of our Board discussions. If it does, I will use what I have learned form this forum to make sure that we do not post. I cannot believe that HOA's are doing this, frankly it seems beyond the pale. But, there are a lot of stupid HOA's out there...we strive not to be one of those!

If the concern is with people leaving guns unattended, that is already illegal. No need to post a sign.

Is this Cinco or Seven Meadows by chance?

When I moved I eliminated 2 homes due to an association, NEVER EVER live in one, just me there, same as ever moving back to Dallas or any other large city.

Unfortunately, for a lot of folks its more like eliminating 90% of the homes within a reasonable (<2 hours RT) commute of their job.
