Texas Man Arrested with Gun During Airport Screening
Another Texas man has been arrested with a gun during airport screening after forgetting to take it out of his briefcase. A new law in Texas will forgive such airport security mistakes made by concealed handgun license (CHL) holders.

Very unfortunate for this guy. I wonder if he'll lose his CHL and or ability to own firearms at all.
I am not and have never been a LEO. My avatar is in honor of my friend, Dallas Police Sargent Michael Smith, who was murdered along with four other officers in Dallas on 7.7.2016.

The laws that forbid the carrying of arms... disarm only those who are neither inclined nor determined to commit crimes.

Since the law goes into effect in a month, I imagine a good argument can be made that this guy has no record, the circumstances appear to fit precisely the situation the new law was intended to address, and although technically a violation, perhaps the interests of justice are best served by dismissal.
Of course, this fellow being an active libertarian and all, he might need to be shown the importance of obedience to our overseers.
I couldn't help but notice this new law came into effect shortly after a member of the Lege was arrested in similar circumstances. Isn't it gratifying to see how quickly the Lege can come around to support an idea when their minds are focused on the problem?

Does the law require that the gun be returned to it's owner before he leaves the TSA area?

Similar happened to one of my students - a professional engineer. It cost him a wad of money, but Dallas grand jury no billed over honest mistake. He eventually got his pistola back.

The new law (which goes into effect next month) says that a CHL holder will be able to complete TSA screening (because it's against the law to abandon the screening once you start) and then exit the screening area to secure the firearm. Police must advise the CHL holder of their ability to do so. Carrying a weapon into a screening area may still result in federal penalties, such as civil fines.
