I am conflicted on this one if he had to chase them then they were no longer a threat.

The claim that the suspects turned to confront the boyfriend saves the BF. However, I was tought to let them run as they no longer pose a threat.

Apparently, the police have no problems with his actions as they do not plan on charging him.

She probably did, but you never know.

That's the legal reason why the PD are not charging the boyfriend. What some of the others are asking is whether chasing after the robbers was such a good idea. One theory goes that if they're not there, they're no longer a threat. Some folks say they wouldn't want to kill someone (and as most CHL's are aware, stopping a threat often means that you have killed someone) over property.

So while yes, in Texas, you can often shoot a fleeing felon, not everyone thinks it's a good idea, or something they would plan to do if only property was involved.

More like poor shot placement. That being said, hitting a target that is moving away from you at night is not easy.

I agree with you. I forgot to quote healthinsp. I would not even shoot someone fleeing over my property. If my family member was harmed in a robbery though, the outcome would be similar to this story.

Details matter. Just because someone is moving away, apparently "fleeing," does not mean that the threat is over.

And if IIRC, the "commission" of a crime like robbery/agg rob/etc includes when the robber(s) are going as well as coming.
