NOBLE, Okla. — A stray bullet fired by a police officer trying to shoot a snake hit and killed a 5-year-old boy fishing at a nearby pond, officials said.

Austin Haley was fishing with his grandfather, Jack Tracy, Friday evening when Tracy said he heard a shot and saw a bullet hit the water just a few feet in front of the boat dock where he was standing.

Moments later, a second shot was fired that hit Austin in the head.

A Noble police officer who had responded to a report of a snake in a tree apparently fired the deadly shot while trying to kill the snake, according to City Manager Bob Wade.

Tracy said he initially thought he and his grandson were under attack by someone trying to kill them, so he put the boy into the back of a 4-wheeler and drove to his daughter's house about 200 yards away.

"Then two officers came out of the brush over there," he told The Oklahoman. "They didn't tell us they were the ones who had been shooting or that they had shot him. They didn't admit a doggone thing."

The boy was taken to an Oklahoma City hospital, where he was pronounced dead.

A resident of the Crest Lane neighborhood called police after discovering a large snake in a tree, Wade said.

"I was told that they tried several ways to get the snake down, but it was still hissing at them and firmly lodged," Wade said. "What I was told is that the owner of the home either suggested or agreed that they should go ahead and shoot the snake, and then everything happened from there."

Wade refused to identify the officer suspected of firing the shots but said the officer has been placed on paid administrative leave pending the outcome of the investigation.

"This is so bizarre it has to be fully investigated. ... We're pretty sure circumstantially that it is the bullet from the police officer's gun, but it might be a bullet from someone else," Wade said.

A state investigation has been launched into the shooting, and it appears the fatal shot was fired by the officer, said Oklahoma State Bureau of Investigation spokeswoman Jessica Brown.

"We have no reason to believe it's not," Brown said. "But there certainly will be an investigation."

Tracy has little doubt about what happened.

"I'm not saying the cop shot him on purpose," Tracy said. "It was an accident. But let me tell you — if I had a kid and put him in this car and didn't put him in a car seat and he got killed on the way to town, they'd charge me with murder ... and what this cop did is a lot worse than that."

Given that only a handful of people die from snake bites every year i wouldn't be surprised if more people died from overreactions like this to the presence of a snake then from snake bites.
It can happen here.

Very sad indeed.

Assuming the snake was poisonous (and an immediate threat to someone), the area reasonably clear....and the area beyond the tree/snake not comprised of unintended targets....then shooting the snake might have been warranted.

Even so, wouldn't a shotgun have been a much better and safer tool?

Yes, or a pruning hook.

I was taught never to point a pistol or rifle above the horizontal. The bullet can travel for miles (in the case of rifles).

While I'm sure that this will cause some consternation, I'm inclined to agree that the officer should be treated as an average citizen would in a similar situation; I don't think an arrest would have been unwarranted.

I feel strongly for the family's loss, I also feel strongly that this will haunt the officer for a long time.

RIP little Austin.

That cop, and the one that was with her, should of both been arrested for manslaughter. :evil:
There aint no excuse for that at all. Period. That snake was was not a threat to anyone.
Gross negligence on both cops part.
I have ZERO sympathy for the cops on this one. Only for the family of that child.
I can't image having one of my little grandkids getting shot in the head.:evil:

Sounds like the officer wasn't using his head. He had many other options here. Shooting at an upward angle was one of the worst options he could have chosen.

If there was nothing else to kill the snake with, I would have suggested that the people leave the area until the snake was gone or found a way to get the gone to the ground, then shot at it.

This type of stuff should be filed under "Common Sense".

NOBLE, Okla. (AP) _ There are now three Noble police officers on administrative leave after 5-year-old boy was killed Friday by a bullet fired by an officer at a snake.

Their names haven't been released. Police Chief Ben Daves says the three are on leave pending investigations by both the Oklahoma State Bureau of Investigation and Noble police.

Daves says in a statement released today officers fired two shots at the snake about 7:30 Friday night and a bullet from a .40 caliber gun hit 5-year-old Austin Haley in the head as he fished with his grandfather.

The boy was pronounced dead at Norman Regional Hospital.



Apparently 2 rookies and a 5 year veteran were there.

This just really makes me angry. The officer firing the shot needs to be charged woth some type of homicide, and any others who didn't stop him need to, at best, be fired.

This is what irritates me ... "It might be a bullet from someone else" let me see I fire a gun and someone 200 yards aways dies from a gun shot. Hmmm

I understand not to say stuff to incriminate yourself but that doesn't mean say something totally stupid.

Wouldn't this have been a job for animal control? It seems to me a simple radio call to have animal control drop by would have solved the problem...shooting at the snake was way over the top.
