Since I started this, I guess I'll conclude that there is a range of opinion on this, and there doesn't appear to be any case law. My takeaway will be that I don't want to be the Guinea Pig.

Ok, but don't be dependent on opinion. Study the law and let the law stand on its own merits, some of which I have pointed out.
