LOL. I run into a lot of posted places as a hospice chaplain. Some only have 30.06 from before 01/01/16. Others are properly posted. I'm compliment a list and am going to start getting them on texas3006. That said, I ran into this attempt the other day. I couldn't help but chuckle as I carried (concealed) right past it. I guess they don't know that they have to post 30.06/07 for 46.035 to take effect.

If you've got to live in a nursing home, maybe it's qualifying for a 51% sign is something you ought to look for.

I saw that same sign posted at my daughter' pediatricians office the other day. I didn't bother taking a picture and even my daughter knew it wasn't effective notice. And she's only 14y.
I am not and have never been a LEO. My avatar is in honor of my friend, Dallas Police Sargent Michael Smith, who was murdered along with four other officers in Dallas on 7.7.2016.

After skimming through 46.035 again, I don't see how 46.035 could possibly apply to a doctor's office that is not attached to a hospital whether or not the doctor's office posted a 30.06 or 30.07 sign. The 30.06 or .07 sign would seem to be separate and not dependent or even related to 30.06 or .07 since they aren't one of the prohibited places. No?

I'm not sure what you mean by the last sentence. However, unless said doctor's office is licensed under section 241 or 242, then 46.035 is not applicable based on the plain language of the law. Of course, even if so as you know, it wouldn't apply unless posted 30.06/.07 anyway.

They can still post a 30.06/.07 and it would be effective notice. Anyone, other than a government building that is not a court, polling place, or detention facility, can post a 30.06/.07, and it would be effective notice. However, it would only be a Class C misdemeanor for violating it. Places listed on 46.035 (hospitals/nursing homes, places of worship, amusement parks, and public government meetings) still need to post 30.06/.07 for it to apply. Violation of said 30.06/.07, I believe, carries stricter penalties.

I guess, somehow, our pediatrician's office think they are considered a hospital. Ignorance on multiple levels. BTW, the day we were there I was carrying my Glock 21SF with the light mounted in a Safariland 7TS holster and two spare mags in a Fobus double carrier and no one said anything. When I saw this thread and the picture of the 46.035 sign I showed it to my daughter. She then asked me if I was carrying at the doctor's office past that sign. My own daughter didn't even notice and we'd been out most of the day shopping for stuff for her for school and softball.

Hmmm.... I would have assumed the nursing home was attempting to comply with paragraph (b) of GC §411.204 but could not locate a sign without the red 51... but I am old and usually wrong.

I hope I'm never in a nursing home, but god forbid if I am... I want to go into one that receives over 51% of it's income from alcohol!! :biggrinjester: :cheers2: :mrgreen:
