His (mis) understanding of the law, coupled with his failure to even look for intent, meant that it was technically impossible for him to have come to a recommendation for prosecution the last time around.
There is another problem. If she wins and is indicted after taking office (highly unlikely), and she does the right thing by resigning before being impeached (also highly unlikely), then Kaine takes over and just pardons her anyway.
