Traffic tickets - disclose?

I have had a few traffic tickets in the past 5 years - 3 to be exact. One for driving without a license, one for failure to control speed, and one for speeding in a school zone.

All 3 have been paid and none went to a warrant. The first ticket, (driving without a license) was deferred adjudication and a reduced fine - and that's the one I'm worried about. I didn't get booked, fingerprinted, or even charged. I did go into the courtroom and speak with the prosecutor or ADA or whoever it was and they offered the deferred adjudication.

Do I have to disclose this on the LTC application? Thanks!

Only if the form asks you for it. Call DPS and ask them.

The speeding and failure to control speed are not required to be reported. The driving without a license is normally a class C misdemeanor, which would not need to be reported. However, if it was a class B or higher, then you may not be eligible as deferred adjudication counts as a conviction for CHL.

Get a copy of the disposition from the court clerk where you were charged and see what it says for the level of the offense. If a B, then you will probably need to wait for 5 years after the disposition to apply.

Driving Without A License is a Class C. Even Driving While License Invalid ( DWLI ) is a Class C unless multiple convictions in which is can be enhanced to a Class B. Bottom line, if your deferment was in a Municipal court it will be a Class C. Our municipal judge grants deferments if the defendants past traffic history allows it. There are certain instances where they are not offered by law such as someone with a Commercial DL.

Thanks for the replies folks. The deferred adjudication was in mid 2011. May or June (My license was issued in June and I got it immediately after the citation and court visit). I tried searching the Nueces municipal court records using my SSN and couldn't find anything. I'm almost certain the deal was if I get my license and avoided being ticketed till September, it was a reduced fine and no record. I'll have to call the court after the new year I suppose and see if they can mail me anything, to be sure though.

Ask the court clerk for disposition on the case. if they don't have anything, or it was for sure a Class C, then you shouldn't need to disclose it.
