The story says that although the idiot with the gun claims that the victim assaulted him, the victim denies placing his hands on him and the police say video confirms this.

I believe if this idiot had stuck his .40 Glock in my face he would not have gone untouched.

Shooting the finger at somebody is hardly de-escalation--in fact it is just the opposite. Then pulling the handgun in this situation--over the top.
