No Check, No Sale Bill

Post by Vol Texan »

I read this on USACarry today. I don’t think it has much chance of passing, but you never know what could happen with the weak-spined so-called conservatives that we have in D.C.

From the article:
Under current federal law, the National Instant Criminal Background Check System (NICS) allows licensed dealers to proceed with a sale if a background check has not been completed within three business days for buyers over 21, or ten business days for those under 21. The new bill seeks to eliminate that default proceed safeguard, effectively halting firearm transfers indefinitely until federal agencies finalize a check — no matter how delayed.
The failsafe process built into the Brady bill was simple: If the government agency fails to do its job in a timely manner, the citizen isn’t punished - the sale goes on as planned. This was designed so that applications couldn’t be pigeonholed forever, denying rights to us.

But of course, what good is a right if we can’t find a new way to infringe upon it? Power corrupts, but absolute power corrupts absolutely.
Your best option for personal security is a lifelong commitment to avoidance, deterrence, and de-escalation.
When those fail, aim for center mass.

I'd much rather see a bill that would prosecute entities that fail to inform information on an individual's criminal, mental illness and any other prohibitive data the for passing a background check. Like the Sulphur Springs shooter that the military had information on him that was never reported. And what happens if NICS has info that they don't use in the time proscribed to deny a sale.

Even if they get this passed and got signed into law (I cannot imagine 47 signing it), it SHOULD be struck down by the Supreme Court. It imposes an easy restriction on purchases. All the background check has to do is slow walk requests. I couldn't process my car registration online because the Texas government was performing "maintenance' . The background check system could "require" maintenance that goes on for a long time.
