Oklahoma

Post by The Annoyed Man »

I might have business reasons for going to Oklahoma City in the next couple of weeks. I realize that I can get a copy of their CHL laws and go over them, but before I do, are there any glaring differences between Oklahoma and Texas law that I should be aware of, particularly with regard to where I can carry versus where I cannot?

Any pointers would be appreciated.

Thanks.

Chris

Is this the list to which you're referring?
  • Max caliber is .45
  • Businesses may prohibit – no reqs for language or method (IIRC)
  • Must disclose to LEO the fact that in possession of a concealed firearm pursuant to a valid CHL issued in another state.
  • May carry into any establishment licensed to dispense alcohol where it does not constitute the primary purpose of the business.
  • Prohibited places - Unlawful to carry in the following:
    • Any structure, building, or office space which is owned or leased by a governmental authority for the purpose of conducting business with the public; (excluding parking lots)
    • Any meeting of any gov. officials, school board members, or any other elected or appointed officials; (excluding parking lots)
    • Prisons and jails; (excluding parking lots)
    • Elementary or secondary school, or technology center school property; (including parking lots).
    • Sports arena during a professional sporting event; (excluding parking lots)
    • Place where pari-mutuel wagering is authorized by law; (excluding parking lots)
    • College or university property (excluding parking lots)
  • Prohibited place does not include and specifically excludes any property designated as a park, recreational area, or fairgrounds;
  • No one can prohibit a person from storing a firearm in a locked vehicle in a parking area.
  • A person is presumed to have held a reasonable fear of imminent peril of death or great bodily harm if the person against whom the defensive force was used was in the process of or had unlawfully and forcibly entered, a dwelling, residence, or occupied vehicle,
  • A person who is not engaged in an unlawful activity and who is attacked in any other place where he or she has a right to be has no duty to retreat and has the right to stand his or her ground and meet force with force, including deadly force.
  • A person who uses justifiable force is immune from criminal prosecution and civil action for the use of such force.
One of my concerns was that the client I might be going up there to see suggested I take in the National Cowboy Museum while I am there. So my understanding would be that CCW would be permitted there as long as there is no specific wording against it at the entrances?

I wonder how .45acp (.451), .45 Colt (.452-.454), .454 Casull (.452) and .460 S&W (.452.) would be handled?

Many street cops would not know bullet diameter, so I would expect no issue with something called a .45.

But I betcha that someone would get hassled for carrying a .460 S&W because it's bigger than .45, when in fact, it's the same size.

Probably not very many wearing .460's, but they could certainly be found in vehicles.

Well, I'm finally headed up there tomorrow to visit a long time friend in the hospital in Enid. My first trip to Oklahoma since I was about 8 years old.

Also consider that OK doesn't have a "vehicle carry" law like Texas :txflag: . Once you hit the border, the gun goes in the trunk,as I interpret it... but then I'm not a lawyer.
Laws that forbid the carrying of arms...disarm only those who are neither inclined nor determined to commit crimes... (Jefferson quoting Beccaria)
