AZ: Harold Fish verdict reversed and remanded to retrial

This is big.

Harold Fish fatally shot a man in self defense in 2004. He was found guilty of murder and sentenced to prison.

The original trial was riddled with questionable rulings by the presiding judge and arguments by the prosecutor that Mr. Fish's defense attorney should have objected to (probably successfully).

The verdict has been reversed on appeal and remanded to retrial.

This is the case where he was convicted because he used a "high power 10mm"

This is why many states, including AZ passed "castle doctrine" laws that simplified self defense and protects us from prosecution.

"Railroad" comes to mind. This is big for Arizona law, and Mr.Fish of course. Just unreal what he's been through.

I've been following this for some time now and am glad it is finally going in his favor. I hope this will be the end of it now that he is out of prison.

Mr. Fish was released from prison Tuesday.

I read elsewhere that prosecutors were not planning to retry the case.

It's not clear to me whether Mr. Fish is now legally a free man with no felony record, or whether he has to jump through more hoops to get his record cleaned up.

I am hoping Arizona does the right thing, clears his record, and does not pursue any further legal action.
