Incident in Houston when I was 11 or 12, no disposition.

Post by M1A »

I have decided to get off the fence and get my CHL. I am at the final part of my online application (payment of $140.00) and realize the payment is non-refundable. I want to make sure I provide them with all the information required. I have only two run-ins with the law. They are as follows…

In 1994-1995 at age 11, I shot an older neighbor kid with a pellet gun (3 pumps) and the pellet stuck in his thigh. He went to tell his mother and the police came. I don’t remember any of the legal details as I was only 11, but I remember a few things. I know I was taken in a police car, fingerprinted and put into a communal room with wooden benches with an open door to wait for a walkthrough of the cells and “The Talk”. I want to say I was supposed to do community service or something to that effect but it never happened as I moved to California shortly there after. I am afraid it was considered an assault and don’t want it held against me.

I have tried to reach the Harris county via phone but they cannot release those records and don’t even seem to know where to looks since they have grown and divided since then. I would go there myself, but I live near Austin now.

The most recent incident occurred in late November 2006. It was a warrant for my arrest that I turned myself in for. On the police reports it says “warrant for duty on striking highway fixture” but the arrest says “leaving scene of accident”. The case was dismissed in the end in January 2007.

My question for the juvenile offense is; what can I do about it. Does it even matter at this point? Am I expected to know the details of something that happened at such a young age? I filled out as much as I know, such as “Date”, Harris for “County” and Unknown for “disposition”.

As for the 2006 arrest; do I put down both “Duty on Striking Fixture” and “Leaving the Scene of an Accident under the arrests section? This should not affect me since it was dismissed correct?

Thanks for the assistance and what a great resource this forum is,

Welcome to the forum.

The incident in the 1990s wouldn't disqualify you even if you had been found guilty of assault. What you can do is get a letter from the criminal court clerk saying that they have no record from that timeframe.

This is a common situation with juvenile incidents.

On the other case, I think you should put the charge that is on the arrest record. You can get that documentation from the city or county where you were arrested (depending upon whether your offense was prosecuted by the city or county).

Arrests are not a disqualification for a CHL, except when you have a pending case.
