I am not for sure if this has been posted yet or not. The "Witness" on TV said they ran out of the store pointing a gun at him.

FORT WORTH, Texas - A store clerk was killed and a delivery driver was seriously injured on Tuesday during a shooting at a southeast Fort Worth gas station.

According to police, three men are suspected in the crime, which happened around 6:25 a.m. at the Valero at 4125 Mansfield Highway, near Miller Avenue.

Daniel Rojas, 22, was killed. An unidentified Mrs. Baird's delivery driver was hospitalized in critical condition at John Peter Smith, Sgt. Pedro Criado said.

A witness saw two men wearing ski masks and holding guns run out of the gas station.

Homicide investigators were looking at surveillance video to see if they could learn anything more about the suspects.

It's not clear if the trio got away with any money.

Family members of Rojas said he had worked at the gas station since he was 16. They said he was a Polytechnic High School graduate and had hoped to land a safer job.

I caught this story on the news. The reporter commented that police were shocked that the men were shot because they had cooperated with the shooters. :headscratch

i live and work in fort worth,its just getting worse it seems.....i think the economy has made some people desperate

I am within about a mile of this area almost daily. It is a rough area in terms of poverty and crime, but this was still a shock. The last update I saw had video with it. There were three men. Only two can be seen on camera. All dressed in dark clothing with ski masks. The employee cooperated with them fully and you could tell he was really scared. As soon as they got the money, they fatally shot him without hesitation. The other victim was a delivery driver for Baird's bread. They shot him the same way and obviously thought they had killed him. He was shot in the head, but is expected to survive. The witness drove up in time to see the perps from his car and one of them pointed his gun at him but did not fire. Apparently they were planning to also burn the inside of the store. They had spread gas around, but the arrival of the customer in his car outside changed their minds and they fled. It makes me mad to think of this young man with his whole life ahead of him and these scum thought nothing of killing him. It's sadly why we carry and why we try to explain our reasons as often as anyone will listen.

There is now a $10,000 reward for information leading to the capture of these guys.

The FBI opinion may not gee-haw with Texas statutes. It reflects a mindset characteristic of the "urban defense" legal theory which argues a person has a high probability of getting hurt once certain conditions arise, and therefore self defense is justified. This argument has been rejected by the courts so far. But this event is very convincing the FBI is onto something with it's statement in the above link a homicide is justifiable in self defense during the commission of certain felony crimes.

This is fairly close to the incident posted recently where a forum member on the way home from a trip stopped at a C-store on I20, and narrowly thwarted an ambush. Near Southeast Ft Worth is a lot like Southeast Dallas.

I don't have to go there anymore, thankfully.

The senseless murder of Daniel Rojas-Torres is beyond my comprehension. I am already wondering if execution is an overkill for home invasion. But I think protection of your family/home is a rational cognitive decision.
But execution of a cooperating victim is beyond anything I can rationalize. Hoot
Hoot, it is beyond mine as well. Life has become so cheap to some element of a 'sub-society' that we now recognize as simply the "bad guys".

IMHO, this should be a Capital Offense, which justifies the death penalty. Short and simple. IMHO.

Channel 5 news just reported that all three suspects are now in custody and what's worse, all three worked at a car lot that is immediately next door to the store. Others said that the 3 visited the store as customers as many as 5 times a day. So often, they reported, that if they had not been masked the boy they killed would have recognized them immediately...it's just almost unbelievable.

I'm so glad they caught the scum. It's incredible that someone they saw so often was still so ruthlessly murdered. I hope they get the death penalty or life without parole. We don't need to ever have those three loose on the streets again.

If I remember correctly this is a Capital Murder case as part of the definition of Capital Murder is...•Intentional murder in the course of committing or attempting to commit a felony offense (such as burglary, robbery, aggravated sexual assault, arson, obstruction or retaliation, or terroristic threat)...and they comitted the murder as part of an aggrevated robbery.


I am very happy to see that the three peices of scum have been caught.
