Trouble Purchasing a Pistol
My dad went into Carter's Country yesterday to pick up my XD9 and had some trouble with the background check. The lady at the counter forgot to give them his social security number or something to do with it, forgot what he said. Anyway, they ended up telling him it would be a 4 day wait before they could try again due to their mistake.
I'm planning on going to academy instead today to buy it myself. My dad was saying something about some 'flags' of buying it for someone else. Since we have the same address we're wondering if it will throw up a flag when I try to buy it today. Does anyone know if I will likely end up getting a 4 day wait or should I be in the clear? Trying to get it today somehow so I can qualify with it at my CHL class tomorrow.
Also, I had a class B misdemeanor when I was young and stupid, well younger. I'm almost 24 now. The misdemeanor was just over 5 years ago and it was dismissed. I've never bought a pistol before so I'm wondering if I will be in the clear on this as well.
Thanks

Re: Trouble Purchasing a Pistol
A Social Security number is not required for a NICS check. NICS also only gives three responses; 1) proceed, 2) Delayed, 3) DeniedDustinB wrote:My dad went into Carter's Country yesterday to pick up my XD9 and had some trouble with the background check. Proceed means you get the gun.
Delayed means there will be up to a 3 day wait. If NICS fails to give a response in the three days the seller is allowed to transfer the gun to the buyer. If NICS comes back within those three days with a proceed, then the buyer can get the gun. If NICS comes back with a Denied, then there is a number for the buyer to call to appeal.
Denied means no gun. The buyer can contact NICS and appeal. if the buyer is successful then NICS will advise the buyer to have the seller call NICS to verify.
There is no option where NICS would tell the seller to wait 4 days and then try again.
Since you are 23, why did your dad try to buy the gun for you? He CAN buy a gun a give it as a gift, but not to someone who is not qualified to purchase the gun theirself.
If he indicated on the form that he was not the actual purchaser of the gun, then the store could not transfer the gun to him. To do so is a felony.
Best bet is for you to go buy it. You might get a delay for the misd., but if it was not a conviction or prohibited offense then you will eventually get a proceed.

Well he works close to Carter's Country and they were $20 cheaper than Academy. Since my truck gets 15mpg and he was up that way it was easier to get him to stop by after work. He didn't say he was buying it for anyone but himself. I'm not sure why they delayed it since he bought a pistol at a gun show recently and had no problems whatsoever. He just said they told him something about a social security number, very strange.

The NICS check can be really stupid like that. The day I turned 21 I was all worked up and ready to go pick up my first pistol - they delayed me for no apparent reason. I went back to the shop 3 days later, they had not received a response, so I got the pistol. I got 2 other pistols the next month and they were all approved fine. I think the people submitting the paperwork screwed up or something - perhaps your dad experienced the same. Of course, when you get your CHL, you won't have to worry about any of that again.

I'm definately in love with it, it's a fine shooting weapon. I got it from the academy in league city, paid $508 even though I could have gotten it cheaper. They were the only place that didn't start any payment til the background check came back so it was worth a bit more. The XD can be had for around $480 on average. Second time shooting one and I scored a 249 on my CHL shooting test today. Took the class with ElGato today and passed so I should be in the waiting room once I receive my PIN.
If anyone hasn't had their CHL class yet and is in the texas city area or close, I highly recommend it. He is more than knowledgable and his stories and humor make those hours fly by.

Academy should match the price....
I've bought several (5) guns at Academy. When I was shopping for my MP. A local gun range was selling the S & W MP for about $20.00 cheaper than Academy. When I told the clerk at Academy about the price difference he said Academy would match the lower price. I think it is their policy but not sure.
I wound up buying my MP40 at a gun show for about $90.00 less than the lowest price. Prices at a good gun show are generally much better than the guns shops.
