51 sign used in movie tavern

My suburb has had a movie theater and full service resturant open lately.
The movie tavern is divided into two distinct areas, a pub/tavern and the movie theaters themselves.
Patrons can sit and drink at the bar and then go into see a movie with full restuarant and tavern service while they watch a current flick.
In a small corner next to the other licences and such is a 51% sign.
Since the theater likely sells more food and movie tickets than booze is the sign valid?
I could call the TABC but I am afraid they might change to proper 30:06 signage.
Please advise.

Welcome to the forum! I am looking forward to hearing some of the answers to your question.

I ran into a similar problem at a bowling alley recently. There is a bar inside of the building that has a window open to the public. People have the choice to sit in the closed bar or order a drink and take it to the lanes with them.

I learned that there are different types of permits issued and that the bowling alley had every right to post their entire building with a 51% sign. I compared the bowling alley to a restaurant with the TABC officer and he told me that, "I understand that it is confusing, but it is the law". I believe it had something to do with how the income from alcholol is reported.

I understand your frustration and as I said, look forward to anything that comes out of this that might help me understand the bar and its limits... :grin: Take care.

I would report it to TABC. If they are improperly posted the chances they will not put up a 30.06. Most of the places improperly posted are because of ignorance not to keep people from carrying. The worst that can happen is they are
1)properly posted
2)post a 30.06
The best thing that could happen is they put up a sign that states it is unlawful to carry without a license, which is the proper sign for an establishment that sells less than 51%.

I recently complained about a local restaurant that had an incorrect 51% sign, improperly located. They sent someone out to check it and talk to the management. next time I was in there they had the proper sign. It was the "Unlawful to carry unlicensed..." sign.
