So.. Going to the Berry Center today, and I distinctly remember it being an 'educational support' center

Looked up the webpage http://www.berrycenter.net/home.html" onclick="window.open(this.href);return false;
Obviously they have some generic 'no weapons' thing posted there, whatever.
Then I looked up the Tax Records, it specifically says 'Land use Code: 4612 -- School'

It is also Owned by Cypress-Fairbanks ISD.

So, the question is, under Texas's broad undefined definition of 'school', would this count?

I've decided to not carry there, but really.. I don't know which way it could go... I see arguments for both sides.

For School:
- It's owned by the ISD!
- It is named an 'educationsl support center'
- Tax Records claim its use is for a 'school'

Against School:
-It's not a brick and mortar 'School', students do not attend it daily for classes.

So, went to the Berry Center, wife spent some money.

They had a 30.06 sign posted at the entrance and exit doors, however it was printed on a single sheet of like 11x14" paper, obviously not a valid size.

What was going on? Have the holiday craft shows started up again?

Yea, big Copperfield Women's Club Craft show.
Wife wanted to go and spend some money on worthless junk... erm, I mean, craft things that she liked :smilelol5: :thumbs2:

I'd really like to bring this one back up since someone put the Berry Center on texas3006.com. If a church rents a portion or all of its facility out to a school (or preschool) during part of the day/part of the week but otherwise its not considered a school, then wouldn't you consider a school that is not in session and is renting its facility to a church to be a House of Worship during that period of time and not a school? So then, would the Berry Center, which is school owned but is not a "school", also follow that same logic? When a concert is going on, or a convention, or a craft show where its been rented out is going on, then that portion of the building would then require proper signage to be offlimits?

Is a building not used for educational instruction considered a school for the purposes of carry as well? There is a facility over near Fairbanks and Windfern where Cy-Fair stores all its crap...I mean surplus equipment. It is not attached to a school nor is there any actual instruction that ever goes on there. Would you consider that to be a school?

I know we cannot answer this question because the law is just not well enough defined but I love to hear y'alls opinions. :-)

Am wondering about this question myself. I was at the Berry Center yesterday for a non-school gathering. There are noncompliant 30.06 signs high above the door thresholds, fwiw. But the question to answer is still whether non-teaching, non-student public school property like the Berry Center constitutes "...the physical premises of a school or educational institution..." under Sec. 46.03.

PLACES WEAPONS PROHIBITED. (a) A person commits an offense if the person intentionally, knowingly, or recklessly possesses or goes with a firearm, illegal knife, club, or prohibited weapon listed in Section 46.05(a):

(1) on the physical premises of a school or educational institution, any grounds or building on which an activity sponsored by a school or educational institution is being conducted, or a passenger transportation vehicle of a school or educational institution, whether the school or educational institution is public or private...

My thought has always been that it is school property and therefore off limits, school function or not. the Leos I've spoken to agree so you would probably take the ride and go to court at least, and I'm not going to be the test case. :leaving
