My student lost his CHL

Hola amigos,

My student lost his CHL a few months ago. I found in the Handbook where it says under GC 411.181:
(g) If a license is lost, stolen, or destroyed, the license holder shall apply for a duplicate license not later than the 30th day after the date of the loss, theft, or destruction of the license.

(h) If a license holder is required under this section to apply for a duplicate license and the license expires not later than the 60th day after the date of the loss, theft, or destruction of the license, the applicant may renew the license with the modified information included on the new license. The applicant must pay only the nonrefundable renewal fee.

But the wording of subseciton (h) sounds like it's talking about if someone lost their CHL and it happens to expire 60 days after the date of loss, then they have to pay a full renewal fee.

My student lost his license, but it won't expire for another 2 years.

Anyone had this experience? What happened?

I think you are right about subsection (h) but, (g) states "shall apply for a duplicate license not later than the 30th day after the date of the loss, theft, or destruction of the license." If they haven't applied within the 30 days they may have to start over. Call DPS.

ZOUNDS! The license was lost two months ago and the licensee hasn't contacted DPS?

OTOH, I've never had occassion to show mine except for a firearm purchase and that happens at greater than 30 day intervals. I'd better look and see if I've still got mine.

He should apply for a duplicate, which costs a $25 fee (same as a duplicate for other reasons). And he SHOULD HAVE done so within 30 days.
Now, if I were not a 100% honest man, I might suggest that he did not REALIZE it was lost until last week. Someone may have turned it in to DPS, so he could not claim to have actually LOST it recently - just that he didn't REALIZE it right away.

Yeah, a couple of his buddies are taking my class. He was telling them about CHL laws and went to get his out of his dresser. :banghead:

Only then did he realize that he had no idea where it was and couldn't remember the last time he carried it (or the gun) but "thinks it was about 3-4 months ago." :headscratch

You hear some weird stuff in this biz....

I told him to just call the DPS.

Sounds to me like it has only been "lost" since he went to look for it. Speculation of when it "could have been lost" is not relevant. He has not been wrongfully charged for not having the license while carrying. He did nothing wrong. If someone took the license or found it and turned it in even months ago he only discovered it missing (date). How can he be punished for not using a license and simply not knowing it was not where he thought he put it?
