SB 354 question
Ok I am a student at UT San Antonio. My question is, that if this bill is signed into law, i noticed a stipulation stating that university transportation is a prohibited place for carry. My problem is that I have to park my car roughly 1 mile from the school and they provide a shuttle bus. Will this shuttle be considered prohibited?
Quote from SB 354
SECTION 3. Amends Sections 46.03(a) and (c), Penal Code, as follows:
(a) Provides that a person commits an offense if the person intentionally, knowingly, or recklessly possesses or goes with a firearm, illegal knife, club, or prohibited weapon listed in Section 46.05(a) (relating to a list of prohibited weapons) on the physical premises of a school or educational institution, any grounds or building on which an activity sponsored by a school or educational institution is being conducted, or a passenger transportation vehicle of a school or education institution, whether the school or educational institution is public or private, unless pursuant to written regulations or written authorization of the institution or the person possesses or goes on the physical premises of an institution of higher education or private or independent institution of higher education, or on any grounds or building on which an activity sponsored by the institution is being conducted, with a concealed handgun that the person is licensed to carry under Subchapter H (License to Carry a Concealed Handgun), Chapter 411, Government Code.

Re: SB 354 question
With that quote, I think the shuttle bus would be off limits, but when I was watching the streaming video, I think I remember hearing a friendly amendment offered to fix that. They didn't take a public vote at the hearing, and we won't know what final language comes out of committee, until it happens.
I believe the basic political division in this country is not between liberals and conservatives but between those who believe that they should have a say in the personal lives of strangers and those who do not.
Re: SB 354 question
That is what I figured. I was also hoping that people would see it and possibly voice an opinion to lawmakers as to a possible amendment. Otherwise I will probably be loosing a lot of weight in the near future.

Re: SB 354 question
It was my understanding from when I took the class that the transportation clause of that section only applies to educational institutions (K-12) not higher education, I agree it may need clearing up though.

You're probably correct; could be clearer, especially when I'm tired and not reading analytically/closely

"school or educational institution"
versus
""institution of higher education" and "private or independent institution of higher education"
(1) "Institution of higher education" and "private or
independent institution of higher education" have the meanings
assigned by Section 61.003, Education Code.
SECTION 3. Amends Sections 46.03(a) and (c), Penal Code, as follows:
(a) Provides that a person commits an offense if the person intentionally, knowingly, or recklessly possesses or goes with a firearm, illegal knife, club, or prohibited weapon listed in Section 46.05(a) (relating to a list of prohibited weapons) on the physical premises of a school or educational institution, any grounds or building on which an activity sponsored by a school or educational institution is being conducted, or a passenger transportation vehicle of a school or education institution, whether the school or educational institution is public or private, unless pursuant to written regulations or written authorization of the institution or the person possesses or goes on the physical premises of an institution of higher education or private or independent institution of higher education, or on any grounds or building on which an activity sponsored by the institution is being conducted, with a concealed handgun that the person is licensed to carry under Subchapter H (License to Carry a Concealed Handgun), Chapter 411, Government Code
(I know you guys hate my coloring/color code-grouping/differentiation too often, but it's how I think/see distinctions)

Re: SB 354 question
Well I submitted a quick note to the good Senator, hopefully the language gets cleaned up a bit.

I'm pretty sure this was fixed in Wentworth's committee substitute.Skaven wrote:Ok I am a student at UT San Antonio. Re: SB 354 question
I know this may be off topic, but it is still important: as mentioned in another thread, the current wording has the penal code changes going into effect Sep. 1, 2012. We should try to get that changed to 2011 imo.
