Used private sale handgun for CHL

Post by Z8442 »

Just recently purchased a used Sig P226 from a friend. He elected to not have me sign a personal receipt for his records. Does anyone see any problems with me using this for my concealed carry pistol? If an LEO runs the gun for a traffic stop and after he sees that I am a CHLer, the gun will obviously be registered to my friend instead of me. Any help on this matter would be greatly appreciated. Thanks in advance.

There is no gun registration in Texas. The gun is not registered to anyone (at least in this State)!

Just make sure your friend is not a thief. If the S/N comes back stolen, you will be taking a ride!

What registration? There is no gun registration in TX. You should be concerned if your purchased a stolen firearm or one used in a felony.
Did your friend signed a paper for your records?
It is recommended to ask an LEO if they can run a handgun serial number against list of stolen firearms database

As others have said the gun is not registred to a individual. You only have to hope the gun was not stolen or used in a crime where they might have ballistics. Did you get a good deal?

Buying anything used, there's a chance it's stolen. Laptops, game consoles, etc.

Thanks for clearing that up guys. I have always made a reciept for myself when I sold guns to other guys and made them sign it. Only good citizens like myself. I wasn't aware that the pistol was not under someones name when they purchased it with the FBI check. I will try to contact a local LEO to try and run the SN for me. I never thought to make a reciept for myself since I was the one buying it. Thanks again

I also have no reason to doubt the friend that I bought it from. But better safe than sorry. And yes it was a good deal I thought. He was hurting for cash and sold me his 1988 sig p226 for $200.

Yep, a Sig 226 for $200 is larceny

What I do in such a case is just make a note of who/what/when/where along with any supporting emails (print it out) and file it in my "Gun records" file folder.

BTW,.....
By Law, there is no Federal Registration Database of guns/owners.

I personally do not know if the FFL discloses the serial number of the gun or even the model of gun when they call in. They may disclose long-gun or handgun but I am not sure on that either.

Also, in case you don't know,.....
Once you receive your Texas CHL your purchases from Dealers/Retailers with FFL's will no longer be called in.

Your CHL exempts you from having to do that anymore. If your Dealer demands that they still do it as "policy" tell them you will find another Dealer and walk away! Some still try to do this and I always ask BEFORE I even start to fill out the 4473 (which is still required for CHL's).

Does he have anything else for sale?

aww, you left him defenseless  ? I don't know if I could take the only gun a guy has got. Gotta at least leave the night stand gun. Maybe you should buy him a baseball bat or something.

If the guy let him take his last gun, then he is either very desperate, or he really isn't a gun guy.
