I wrote:Whoever shot the guy did not have time to perform a sobriety test or to determine that the children were dead (one wasn't, at the time). That's kinda why we frown on vendettas and lynchings nowadays. Most people involved in an injury accident try to help the victims and call 911.
I got that one about as wrong as possible.

Anyway, people don't get a get-out-of-jail-free card for killing a criminal after the fact.

:eek6 That's a bit beyond "sad"

Update:
Fox 26 legal analyst Chris Tritico says if the case goes before a jury he likes the odds of acquittal.

"I would be comfortable in any county in Texas trying a case like this where the emotion is going to swing this heavily in favor of the defendant," said Tritico.

Chris Tritico is one of the best criminal defense lawyers in Houston. Among others, he was on Timothy McVeigh's defense team.

With Temporarily insanity defense he might be off the hook.

They apparently have zero physical evidence or witnesses to prove he shot the man at all.

Showing the photos of the sons he lost as evidence of the incident, should be enough "emotional" evidence for acquittal.

Doesn't the prosecution have to prove he did it first?

I wouldn't make it onto that jury. Not because I condone what has been alleged. But I could not send a man to prison for the rest of his life for reacting the way that he is alleged to have. To see your sons sliced and diced....... a person is not sane at that point. That is about the most traumatizing thing I could think of a parent experiencing.

According to the article they didn't have anywhere near the evidence necessary to overcome reasonable doubt.
