Drivers License Suspension Question

If my drivers license was temporarily suspended, for like a week, will that effect my CHL status? Does a suspended drivers license automatically suspend my CHL?

Assuming the underlying infraction that cause the suspension is not something that also causes CHL suspension, just the fact of a suspended DL does not also suspend the CHL.

However, recall that if asked to present your CHL to Law Enforcement, it must be accompanied by valid government-issued identification. A suspended DL is not valid Govt ID.

I'd suggest getting a Texas ID card if you are going to be without a drivers license for any non-trivial period of time.

Passport would also work.

You could get your DL revoked for a variety of reasons that would not affect your CHL.

JF that is incorrect, your license being suspended does not invalidate it as ID, just means you cannot use it to drive

It is still valid as ID, just the privilege of driving is suspended, which is a DPS administrative action, usually because of a surcharge due.

FYI - if you drive and get a DWLI ticket (about $250), you also get 3 more years of surcharges ($200/year)

So...you can kiss just under $1000 goodbye if caught. It's a racket for state.




All that said, I rarely wrote DWLI tickets.

Minor technical correction, but if your DL is suspended, it is illegal to be in your possession. Transportation Code 521.315 says that DPS may ask for it back and you are committing a class C if you keep it. Texas Administrative Code DPS rule 15.88 says that they will ask for it back and takes away their discretion.

Second minor technical correction, but a passport is not a valid ID for a CHL. Government Code 411.205 specifically says you will provide your DL or DPS issued ID card. It does not say that a passport or any other ID is acceptable.

However, especially in consideration of the last, the good news is that there is no longer a penalty for not having your DL with you.

If you were driving with a suspended driver's license and had no insurance or a prior DWLS conviction this would make the DWLS a class B misdemeanor.

Would it still be legal for you to carry a handgun concealed in your vehicle while driving with a chl??? Considering that you would be in the commission of a class B misdemeanor at the time of the traffic stop.

It might cause a problem for MPA but shouldn't affect CHL unless that is suspended too. If somebody embezzled from their employer, it shouldn't also be UCW because they didn't disarm first.

Motorist Protection Act.
Allows you to carry a firearm in your car w/o CHL.
