We are waiting on a trial setting now. It should be within the next 3 to 4 months.

I am not familiar with the law. Will NETT be reimbursed for legal fees if successful?

No, Kaufman County is the plaintiff.

If there is some extra money in the fund afterwards, can we use it to sue the plaintiff for something as frivolous, just to cost them money in defense? Sort of a "tit for tat" to teach a lesson in going after good honest people for no good reason. :reddevil

Thanks keep us posted. Any chances of him getting a claim for damages when this is over?

I understand that this case finally made it into the courtroom yesterday (Monday, September 9). The local paper in Kaufman doesn't show anything about it yet in their online edition. Does anyone else have any news on what is happening? I'm too swamped at work to be able to drive out there & sit in the crowd.

(P.S. I didn't see anything in the forum rules about not resurrecting old threads, so I figured it would be better to post here than to start a new one. Please correct me if this is not proper etiquette on this board - I know it is frowned upon elsewhere.)

I heard that the case was decided in the range owner's favor today. I don't have a source better than, "a guy told me" so take it with a grain of salt.

Good evening everyone The trial is over and we won! The Jury found that we did in fact start operation prior to September 1st so the issue has been resolved. Thank every one of you for your support and help through these past couple years.

This is correct, we won the case. As noted above, the jury found that the range began operation prior to Sept. 1, 2011.
