Technically, he's right. There is no law against posting an unenforceable sign.

I ran into this at a gun show in Cedar Park. It was posted 30.06 by the event coordinator (not the city). They had private security as well as local PD at the door.

Here's how I approached it:

I put my cell phone in my shirt pocket with the camera sticking out, recording.
I went and talked to the local PD at the gate, disarmed. I told the officer that I was confused, as I had heard from a "CHL Instructor" that 30.06 signs are not enforceable on city owned property.
I was told that the signs were there to prevent "trouble" - some reference to problems at prior events - people loading or unloading firearms.
I was also told by the officer that I was speaking to that he was unwilling to make an "illegal" arrest, but he wasn't completely sure that someone else wouldn't be willing to make one.
That was good enough for me.


I'd recommend recording it. You record it so if the LEOs don't know the law you can take it up the food chain later without having a dispute about the facts. If they're willing to arrest - they're either intentionally ignoring the law (which is good to have a history of - I'd post that stuff publicly) or they don't know they law, in which case they need a little education within the department. Either way, you're doing some level of service for other CHLs.

I agree with JMRA - there is a good chance if you piss them off that they can take you to jail with little personal consequence. It's a relatively obscure exclusion.

I am curious why Cedar Park Center still has a no weapons policy if they are owned by the city. Is this legal or not? If not, why is it still that way, and on their web site.

a. Ignorance of the law.
b. Contempt for the law.

Is the Cedar Park Center really owned by the city or is it owned by the Stars and Spurs organizations? If it is owned by the city then any prohibition of CHLs would be unenforceable except during professional sporting events. Semi-pro still counts.

I guess the next thing would be to wonder how many of the sporting events held there are automatically off limits and whether or not they post the 30.06 sign as a reminder. They would be enforceable during those type of events. It would be very misleading if they wouldn't enforce them during other times and not bother to take them down.

Since professional sporting events are statutorily off limits the 30.06 sign is unnecessary. Residents of Cedar Park can take it up with the city with SB273 as their ammunition, pun intended.
