When thinking about this or similar scenarios, I am crystal clear that I have no duty to act light like Buzz Lightyear ("Reach for the sky!"), command them to "Drop the weapon", or otherwise provide any warning of my impending hostile action. Their first warning is a muzzle report which they may or may not be alive to hear.

RIP. What a shame. Died while trying to protect a loved one. My deepest condolences to the family.

There is no law stating you must warn somebody first. He would not be the first Leo to die after giving a warning and loosing the element of surprise. Very tragic
