Although I would prefer that all BGs use pitchforks rather than guns, I would say about this guy "what a loser!"

Over the last several years, there have been several robberies of Waffle House restaurants in Houston. I think that part of it is the locations tend to be near freeways so a quick get away is possible. In Texas, I'm assuming that would have been considered a deadly weapon in the same manner as a knife with a deadly force response justified.

Robbery is one of the six crimes ("aggravated kidnapping, murder, sexual assault, aggravated sexual assault, robbery, or aggravated robbery") where deadly force is both justified and presumed reasonable (PC §9.31(a)(1)(C) and PC §9.32(b)(1)(C)).
