Couple of things. First he didn't get off anything since he hasn't had a trial yet and he is pleading not guilty. The prosecution doesn't get to pick his defense so what they think about it matters little. If you think he is being undercharged then so be it but it's the charge I would expect. As to the whole gravity issue I'm sorry but I've never heard of anyone being hurt buy shotgun pellets. If fired at a high angle the pellets will fall to earth with a terminal velocity of between 200 to 300 fps. Most BB guns shoot faster than that. Unless the guy has shooting at a relatively low angle and or was shooting slugs or specialty ammo there isn't any real risk besides someone looking up and getting hit in the eye.
