Question: Selling a Handgun to a Stranger

In Texas you can sell to a minor, even a 5 year old, as long as you meet state:

(c) It is an affirmative defense to prosecution under
Subsection (a)(2) that the transfer was to a minor whose parent or
the person having legal custody of the minor had given written
permission for the sale or, if the transfer was other than a sale,
the parent or person having legal custody had given effective
consent.

I wasn't aware of that, so thanks.

But anything that is an defense to prosecution means you can be arrested, charged, and go to trial, which is a heap o' grief.

Truthfully if you want to do it "right" do it through a gun dealer and do a transfer. that way the weapon is completely out of your name and into theirs.

If the parent wants their minor child to have a gun, they can buy it themselves and gift it to them. Worked well for my parents.

We are not required to background check anyone in a private sale.

I did two face-to-tace pistol sales (bought 1, sold 1) to different fellows (Internet-generated transaction) and THEY were the rather cautious ones that wanted to see ID and do a "bill of sale."

Guess what - I didn't let either of these nice men have my ADDRESS, but they gave me theirs in their papers they drew up.

If I'd have gotten bad vibes I'd have quashed the deals, but these were normal fellows (like most people) and I guess I appeared somewhat normal with my American pit bull terrier in the car trying to get to them ... to lick on them! .... heheheh.
