From the weekly crime blotter in Friendswood. I am not sure if he really fired his gun but he admitted that "he might have picked it up the gun".

Road Rage Incidents Erupt in Gun Fire and Stone Slinging



Early Sunday morning (April 26), around 2:00 a.m., two women were in a car stuck in traffic near the intersection at FM 2351 and Interstate 45 due to a car crash when the truck behind them began honking the horn and then went around them on the shoulder of the road. As the driver of the truck got beside them, he yelled at them and said, “what are you trying to do, get shot?” When the women asked him “for what?” the man pulled out a gun and fired a round. The women called 9-1-1, provided the license plate number and followed the suspect until he turned into the Baywood Apartments.



When an officer arrived, he found the suspect vehicle unoccupied in the back of the apartment complex. The license plate returned to a resident at 5025 FM 2351, so officers approached the apartment and made contact with Reuben Nuncio, 49, of Friendswood. Nuncio told officers that he got into a confrontation with another motorist because that vehicle was not moving. When the officer questioned Nuncio about shooting the gun, he denied ever brandishing the weapon. Another officer noticed a gun lying on the table by the door, just inside the apartment. While being questioned, Nuncio changed his story and said that he might have picked up the gun but couldn’t remember because he was scared.



The gun was seized as evidence and Nuncio was taken to jail. Reuben Nuncio, 49, of Friendswood, was charged with Unlawfully Carrying a Weapon by a Concealed License Holder.

Road rage is so stupid.

I know a former CHL in Ohio that was convicted of aggravated menacing (misdemeanor) for brandishing a handgun at another car in a road rage incident. :roll:

I have to wonder about the charge 'unlawfully carrying a gun'.

He may have unlawfully discharged it, or displayed it in a way calculated to cause alarm, but if had a CHL and was legal to possess I don't see it.

Doesn't current law require a firearm in a vehicle to be concealed? If someone else saw it, it's no longer concealed. Not a LEO, but could this be a preliminary charge while they decide on brandishing or discharge?

I don't know.

If you, while carrying your gun, display the gun will you be charged with intentional display or unlawful carrying of a weapon by a permit holder?

You may be right about the preliminary charge and we don't necessarily know the other facts.

Wow, foolish behavior. If it happened as written, I am surprised he was able to make it to 21 without any criminal record.

Lots of people get pretty angry in traffic. Can't lose control though.

He obviously did not react well, but I do wonder if events happened as stated or if there was more give and take in that confrontation before he pulled a gun.

Doesnt suprise me from people living on that side of friendswood. they should just rename the harris county side of friendswood to "the wrong side of the creek friendswood".

How is a charge like that even possible to prove in court?

Correct. "Unlawful carrying of a weapon/gun/handgun" is a generic phrase. The charging document will list the specific code provision he is accused of violating.

I know someone personally who literally just yesterday told me that he does that, brandishes his gun to people who are driving stupid trying to run him off the road, or slamming their brakes in front of him. But he isn't doing what this guy did, or so hes told me. He said when people go acting the way that this guy did to those women to him he just turns his cabin light on, and holds his gun up and the people will usually just speed right on up and leave him alone. I suppose that's different, though from this particular case you posted about.
