concealed carry at gun show ok'ed by LEO
Went to big town today, I was in line to get my personal carry zip tied, guy in front of me pulled from holster what looked like an MP 45 to get tied. LEO asked if it was loaded, to which guy said yes. LEO said has to be unloaded before coming in, then asked if he was going to be taking the pistol out to check holster fit or trade offers. Guy said no and LEO said go on, just keep it in the holster. Big ol 30.06 sign right there. Just wondering about this if something were to happen or if a floor LEO spotted the loaded weapon?

Where was the gun show being held? Was it on city owned property?

I think he's referring to the Big Town Mall gun show they have every month:nightmare69 wrote:Where was the gun show being held? Was it on city owned property?

I don't know who owns the mall.

Uh Oh. I wonder what the LEO of the first part would say if the LEO/s of the second part put the arm on the guy with the unzipped gun in a holster?
Re: concealed carry at gun show ok'ed by LEO
This is a simple answer...
The 30.06 prohibition requires two conditions to be met...
1. That there be lack of effective consent to entry onto the property by the owner or someone with apparent authority to act for the owner.
2. That one of the three forms of communication, verbal, written, or signage, has been given.
The absence of either of these two requirements means there is no 30.06 prohibition.
The LEO, who is guarding the entry of all patrons into and onto the event is about as an apparent authority as it gets. He gave his consent, with conditions, and the 30.06 prohibition for that patron is non-existent as long as he follows the LEO's conditions.. Sign or otherwise.

....unless the guardian of the gate denies having given his verbal consent when questioned/challenged by his superiors/employers.thetexan wrote:This is a simple answer...

The absence of either of these two requirements nullifies the prohibition.

If I can't trust the LEO at the gate to honor his word then we have a bigger problem. To protect ones self perhaps getting the name of the guy behind you as a witness might soothe one's concerns. Or, immediately seek out the floor LEO and confirm with him what his partner just did and verify that everyone is in agreement. If not, just leave, as per 30.06. No violation.

Doesn't feel like the juice is worth the squeeze when it comes to this one.
I don't hit the gun shows often, but when I do (Ft Worth is on my schedule for Saturday) its just way less stress to leave the guns locked up in the car for a few hours.

Perhaps.

Re: concealed carry at gun show ok'ed by LEO
Several years ago when I went to the gun show at Market Hall I was unaware that a city owned venue would violate the law as they do and was carrying up to the entrance. After learning about their rules I decided to return my ammo to my truck and return, allowing them to zip-tie my carry gun before returning it to its holster and cover it back up. I was shopping for other holsters, so I did want it with me. You all know the irony about the ammo issue. They had a couple of large containers that they required people to empty their ammo into if they did not want to return it to their vehicle. I did not want to give them $40+ worth of ammo. We've all seen this many times at various shows where the law prohibits a CHL from being prohibited from carrying their gun.
Even if the LEOs at this Big Town show feel like they've allowed people to continue to carry, requiring them to unload their gun is no different in my view. However, I will concede that the BTGS building may not be owned by a government entity and can enforce the posted 30.06, so my opinion may not apply to them. For other shows, when I do go, I'd rather not go through the hassle of pointing out their error and violation of the law and still lose and not be allowed to carry a loaded gun concealed, so I reluctantly disarm before going in. If I do want to bring a gun in for any reason, I play their game by their rules and bring it in a case unless it is a rifle, which I just OC with a sling at that point.
Hopefully, all this will be resolved soon with the threat of penalties for non-compliance with the law. However, I'm worried that it may not due to the notification requirements. Before all those requirements are met the show will be over and will have moved along.

I am not and have never been a LEO. My avatar is in honor of my friend, Dallas Police Sargent Michael Smith, who was murdered along with four other officers in Dallas on 7.7.2016.
