State Agency Employee Policy affected by SB273?

New to the site, joined specifically to ask this question....does SB273 (or another legislation I'm unaware of) affect a State agency from prohibiting concealed carry by an employee simply though an employee policy?

I've worked for the State for well over a decade, and had a CHL for longer, and the agency employee policy has always prohibited employees from carrying a weapon, licensed or not. As a CHL holder, that severely limits when I can carry and, as a result, I rarely carry.

Unfortunately, I do not know of any law that prohibits employers, including state agencies, from prohibiting the carry of weapons while at work or on company time. Maybe someone else will come along that may.

Welcome to the forum HuggyBear911! Glad to have you with us. :tiphat:

That same question was asked a while back of a state employee working for a state employer, and the response was, that an employer, even State employer, does have the right & ability to restrict a CHL from carrying while at work. The employer cannot prohibit you from keeping your gun in your car, of course, due to the parking lot law.

Thanks for the quick replies!

I was afraid that was the answer. Was discussing this with my Uncle over the weekend (also a CHL holder and retired State employee) and neither of us was clear on the issue.

Yes, much of what we discuss here are unclear issues. About as clear as 6 feet of muddy water. :lol:

Just because you can't carry at work doesn't prevent you from carrying everywhere else it's legal, does it?

Or, am I missing something?

Certainly not, but I spend a lot of time at work (and driving to work, lol) and if I can't carry there it seriously limits when I can. It just got me out of the habit of carrying and now I rarely do.

Are there constraints, as in threats of a loss of job regarding leaving a handgun in your car while at work on company property? Yes, I know laws have passed about this, but some employers still persist irrespective of the law...

If not, you would have the option of being armed coming and going, plus everywhere else it's legal.

I car pool about 90% of the time, so that's unfortunately not an option either :(
