Student attending track championship was stabbed in the heart by another student over a seat dispute. He died in his twin brothers arms.

The murderer was arrested and is pictured in the article.

Father of stabber says his son was not the aggressor. “A good boy”

Other news stories say the stabber admitted the stabbing to police and said it was in self defense.

It was raining and the victims school had sent up a tent for their students. The stabber was from a rival school, and I guess was asked to leave.

Stabber's bond reduced to $250,000 which will allow him to be released with an ankle monitor. He may have to stay at home as well.

His situation is being compared by some people to Kyle Rittenhouse in the deadly shooting in Wisconsin. See photo.

Can you claim self defense if you’re illegally carrying?

Can you claim self defense if you respond with more deadly force, unless you’re over 65, for example responding to being grabbed with stabbing with a knife?

You can always claim self-defense, but that doesn't mean you will win. Penal Code section 9.31 says you can use force, but not deadly force in self-defense against the other person's use of force. If the story is correct that the other student pushed Karmelo first, he could have hit back or shoved back as self-defense. Section 9.32 says he could have used deadly force to defend against the use of deadly force or to protect from specific crimes that no one has alleged yet. Section 9.01 defines deadly force as force that is capable of causing death or serious bodily injury. I think the knife meets the definition of deadly force and does not appear to be justified from what I have read of the case (note I have not seen any case files, just media reports).

The theory of disparate force is always possible to claim. This is not restricted just to senior citizens, though it is commonly thought to apply in those cases. This theory is simply the belief that the initial attacker had so much potential to harm the defender that the defender could not had possibly defended himself by the same level of force as the attacker used. One possible area where this might play into this case is the number of attackers versus Karmelo being alone. While he was only initially attacked by one person, that attacker had friends, relatives, or associates with him that might reasonably have been presumed to join in on the attack against the lone student. That might even possibly justify the stabbing. It would depend on more facts than I have available to me and would also depend strictly on a jury's decision. They would be the ones to determine if his fear of the multiple potential attackers was reasonable or justified.

Swatting seems to be a common thing now-a-days. What are the police doing about it? It should be considered a violent crime IMHO

48 months is a slap on the wrist. Seems that he should have to pay a lot of restitution
