New CHL Regs I Didn't Know
Yesterday turned out to be LEO day at the range. We get most of the LEO's from most of the various agencies practising here but yesterday afternoon they were just about lining up. A couple of the guys are well know here and sometimes hang around to swap yarns.
One of the fellas yesterday finished shooting and hung around a couple of hours talking with us. He's been on the local PD 5 years and was with others previously. Lots of good info, including the escalation of crime on the border, the increased firepower of the bad guys and the Mexican governments lack of cooperation.
We eventually got around to legal carrying of guns and CHL. He is supportive of good guys carrying but reminded us "it's not legal to carry in Circle K (gas station/convenience store) because they sell beer and you can't carry in a bank". Well, that was all new to us so we decided to educate him.
We gave him his own personal CHL class and he went away totally amazed. He had no knowledge whatsoever of PC 30.06 and thought that a crossed out revolver in a circle was a legal prohibition.
Sometimes I just wonder.

Did you provide him with the URL for this site? I would say that some of the instructors on this site are definitely a leading authority!
I know I have learned a great deal by reading the post and I really thought I was pretty educated about the laws. Take care.

I don't know what you are talking about... I learned that I was an idiot on this site. I didn't know squat, jack. Just call me Mr. Ignorant. And that is after taking the CHL course and having a pretty decent instructor.
Either that, or my assesment of legislators and laws was pretty right on. They are mainly sadistic and the laws are needlessly complex and obfuscated (probably on purpose).

I like the signs those convenience stores have now. They spell it out pretty good when they say '...unlicensed possession...'nemesis wrote:"it's not legal to carry in Circle K (gas station/convenience store) because they sell beer and you can't carry in a bank".
Sounds like you did a fantastic job educating him! I hear all kinds of stuff from people about where you can carry and where you can't.

While we're talking about it, this is a pretty good list:

I was most surprised that apparently in theory, with a CHL, it is legal to take a long gun on Premises of businesses licensed to sell alcohol. Must be some kind of loophole in the law? Wouldn't want to try that one out though. It would be just asking for all kinds of trouble.

The problem is these laws determine if you drive off or get some new fancy bracelets for the ride downtown. It seems like beat officers pulling people over often would be brushed up on this stuff. I know it is easier to say that not being in the position, but still scary all the same!

Someone correct me if I'm wrong but I believe it is legal prohibition under 30.05 which would apply to non-licensee’s and off duty LEOs.nemesis wrote:He had no knowledge whatsoever of PC 30.06 and thought that a crossed out revolver in a circle was a legal prohibition.
Just thinking that may have lead to his confusion.
HELLO! I would have rather skipped the CHL class and just been mandated to read this site. I still could have passed their little test. I am glad that it is not any harder than it is I am getting old and forgetful.Kalrog wrote:I don't know what you are talking about... I learned that I was an idiot on this site. Correct, an international slash sign with a pistol in the middle probably would be sufficient to prohibit entry for non-CHL holders, per TPC §30.05. §30.05 does not specify any particular language, as does §30.06. An argument could be made that the "slash" sign is ambiguous as to its scope, but that's not the issue here.mschadt wrote:Someone correct me if I'm wrong but I believe it is legal prohibition under 30.05 which would apply to non-licensee’s and off duty LEOs.nemesis wrote:He had no knowledge whatsoever of PC 30.06 and thought that a crossed out revolver in a circle was a legal prohibition.

I used to somewhat jokingly say that "no guns" signs that don't comply with §30.06 apply only to criminals and off-duty COPS, but I can't say that any longer. With HB823, non-CHL's may well have a gun in their car and the law was changed making all LEO's (even off duty) exempt from §30.05, if the sole reason for excluding them from the property was the possession of a firearm. (Yeah, I know the "I'm never off duty" argument, but it doesn't fly with non-commercial private property.)
Regards,
Chas.
