I talked to NICS about long delay

I called NICS and asked about the long delay I get. I've never been cleared before 30 days. They told me its because they are unclear on a deferred disposition that I received in 1992. They don't see the release from deferred adjudication. The nics lady said that they have to call the district clerk where the offense was committed. Then someone from the clerks office is supposed to call them back. The records they are looking for are on microfilm because they're 20 years old. I know darn good and well that some clerks helper is not gonna take the time to go get that info and call them back! I've already gotten certified copies of all that stuff. WHY can't it be as simple as the FBI calling me a saying " look, we're not clear on your old charge. Can you fax us the certified documents that are in question?" That would take 10 minutes, not two months. I already sent the FBI the same documents I sent Dps. I sent in the VAF to the Feds. They said that they are 6 months behind on reviewing the Vaf's. Just imagine the Feds doing the whole nations health care. It will be a nightmare. They can't even make a simple phone call to clear something up. So I figure that's what is taking my BG check so long. Dps has all the documents, I've lived in texas my whole life, same address and job for last 10+ years. I've also been cleared for multiple security clearances for my job. I've been cleared for non Escort status at the DPS, Travis Co Jail, and the Travis Co Corr. Complex. When the NICS lady told me that a clerk from the Travis Co Courthouse would have to physically go get the info (off microfilm) and send it to them. All I could do was laugh. I'm sure they'll jump right on that. They have a million things more important to do than worry about my 20 yr old case.

Yeah, I asked the NICS lady if it was going to take forever for the Feds to give DPS the go ahead on my BG check. Will it be like when a dealer calls for a gun purchase when I'm trying to buy a gun? She said, " Well, hopefully not because the DPS can kind of 'backdoor' our system and hopefully they will share all the info they have so we can update our records." ... So I don't know what the heck their process is. Just hoping they will hurry up. I wish somebody actually knew one of these background check specialist so we could get more detailed insight on what really happens behind close doors. I cant help but wonder..Are some workers just way faster and better at it? Or are the ones that take forever just that much more thorough? Are some workers just slow and spend half the day out back on smoke breaks? Did the guy that has my app. go on vacation for spring break? Who knows!

I have a couple of questions.

1. I thought that when waiting for NICS approval that if they did not approve or deny within 6-7 days that the FFL could turn over the gun to you specifically because their was not a denial.

2. Have you considered getting PIN number for this. On the 4473 form it asks for a PIN number. I don't have one, but from the way I understand it, most of the people that get one have some kind of issue in their background like yours that will make it difficult and cause delays.I think the PIN number is for when they have it worked out once and you get the PIN number to alleviate that problem in the future.


Can one of you FFLs verify wither of these thoughts?

Yes, C dub the only FFL that would not sell me a gun after 3 working days is Academy. All others have released the firearm to me. As far as the UPIN #, I sent my Volunteer Appeal Form in the same time I did my CHL packet. Which was Jan 31, 2013 from Austin. The FBI told me I the phone and also in a letter that they were just now getting to October's FAL's. So they are way behind on looking at the UPIN forms.

I do the mandatory wait and do the transfer, I do not care if it takes them 30 days i do not make customers wait. If I have no reason to believe the person buying is doing it illegally then I have no reason to make them wait. Hopefully you will get a UPIN issued and avoid the wait (or get a CHL).

I have my fingers crossed that I'm part of the Sunday batch. I'm not going to check the site till Tuesday. I've been driving myself crazy checking my status all the time. Once I get the CHL the Feds can take all the time they want. I bet they don't issue me a UPIN # for atleast 6 months to a year.
