criminal tresspass

Post by maximuslion »

Thanks in advance for your help guys.....

I was arrested in 12/2004 for criminal trespass. I received deferred adjudication and completed my probation/community service in early 2005. Will this disqualify me from receiving my CHL ?

I don't believe it will disqualify you. As I recall, misdemeanors are a blocker for 5 years.

I was thinking it was 7 for some reason, but I could be wrong. In any case the OP should be OK.

If you don't have a chl misdeminors block for five years If you have a chl then the block
is for 2 years after the block no longer exists making it 7 years..If arrested
for a misdemenor turn in your chl before it is revoked and save the 2 years

I also was arrested for criminal trespass in July of 2011 when I was 17. I took my class Sept.2, applied online through Texas DPS website and got fingerprinted today. I hope I dont get denied.

your post is a little confusing.... if you were 17 in July of 2011 then that would make you 19 now and you have to be 21 to get your chl in texas. if you were convicted in 2011 then you wouldn't be eligible until 2016.

forgot about that, thanks for the update. the arrest (if convicted) would still be a no-go.

So were you arrested or where you convicted?

A conviction matters.

An arrest that has since been dismissed or dropped does not affect eligibility. (Obviously, a current arrest that is not yet resolved does count.)

Go look at the other topic I linked to in this post http://texaschlforum.com/viewtopic.php? ... 82#p852662" onclick="window.open(this.href);return false;

He was convicted and received deferred adjudication.

Trespass is generally a class C misdemeanor unless you were armed. Would not be prohibiting even if convicted, unless it was a higher level offense due to the premises.
4/13/1996 Completed CHL Class, 4/16/1996 Fingerprints, Affidavits, and Application Mailed, 10/4/1996 Received CHL, renewed 1998, 2002, 2006, 2011, 2016...). "ATF... Uhhh...heh...heh....Alcohol, tobacco, and GUNS!! Cool!!!!"

Criminal Trespass can be anything from a Class C to a Class A midemanor. Depends on where the trespass occured and under that circumstances.
