Police academy carry

Post by nightmare69 »

Im going to the east Texas police academy in January and it is through Kilgore college. Kilgore allows students with a CHL to carry but when I asked the police academy they said there is a law the forbids carry in the academy and the academy is separate from the college. What law prevents me from carrying into a police academy? If they don't allow it I will disarm, don't want to get kicked out over something stupid.

No, its not a K-12 school. It a academy through a college, their main website is in the link. Kilgore college allows CHL to carry but the director at the academy said state law prohibits carry at the academy. Im not going to argue with them but would like to know what law that is.

He may be confusing it with the Federal Law.

I don't know but its not a big deal, the instructors are cops and Im sure a few are armed. Everyone there is at least 21 or going to turn 21 by the time they graduate so all could possibly have a CHL.

TPC 46.03 does not define what a school or educational institution is, so not limited to K-12. It can include college or other schools, as well as private schools. The academy is a school, so will bet they are using 46.03 as the law quoted.
Sec. 46.03. PLACES WEAPONS PROHIBITED.
(a) A person commits an offense if the person intentionally, knowingly, or recklessly possesses or goes with a firearm, illegal knife, club, or prohibited weapon listed in Section 46.05(a):
(1) on the physical premises of a school or educational institution, any grounds or building on which an activity sponsored by a school or educational institution is being conducted, or a passenger transportation vehicle of a school or educational institution, whether the school or educational institution is public or private, unless pursuant to written regulations or written authorization of the institution....

Thanks Keith.

I thought a school was defined as grades K-12 and the police academy would fall under college/institute of higher education.

Colleges are still off limits as they are an educational institution. Not sure how you are looking at the laws and trying to say they are exempt?

I know in our academy that we ran, it was a definite NO for anybody to bring a loaded gun and even an unloaded gun with ammo to the facility unless they were already commissioned and there for advanced training. There are too many exorcises using those unloaded guns. This is probably a safety restriction for the right reason.

I was told that they don't want an armed student to fail a test as they might "go off" If he would've said that with a british accent then he would have sounded just like Piers Morgan.

I looked at the 2011-2012 Student Handbook posted online, and I don't see anything that supports this. Do you have a link to the policy?

I have heard that they allow CHL to carry through friends who went to Kilgore college. I have never called and asked the college personally.

LOL don't know who you are talking too, but trainees don't need ammo in their guns at the academy expect on the range. This keeps the accidents down.
