Racetrack off limits

I have read a few threads but still cannot find a answer. A racetrack is defined as...."Pari-mutuel wagering" means the form of wagering on the outcome of greyhound or horse racing in which those who wager purchase tickets of various denominations on an animal or animals and all wagers for each race are pooled and held by the racing association for distribution of the total amount, less the deductions authorized by this Act, to holders of tickets on the winning animals.

Ok so it has to be a place where you can place bets correct? I thought gambling was illegal in Texas. So Nascar and NHRA events would be off limits because they are a professional sporting event but what about a racetrack such as Lone Star Speedway?

Racetrack is horse or dog tracks, not a car racetrack. However, an event at a car track like Texas Motor Speedway or other facility MAY be a proffesional sporting event, so it would be off-limits too.

And horse and dog racing and para-mutual wagering is legal in Texas.

Where do we have a horse or dog tracks here in Texas? Can I carry into Lone Star Speedway?

And, read my post above, a car racetrack is not off limits in itself. If the event is a professional sporting event, then you can't carry there. An example is NASCAR is a professional sporting event because their drivers are all paid professionals.

They have amateur dirt track racing out there all the time and even some modified and sprint car racing. A buddy went last weekend and asked of it was legal to carry.

Gray area. The track itself is not a 'racetrack' as defined by statutes, but there could be a question as to the drivers or the event being a professional sporting event if drivers are paid for driving. So, it's legal to carry at the track by itself, but the event may make it off limits.

"Premises" means a building or a portion of a building. The term does not include any public or private driveway, street, sidewalk or walkway, parking lot, parking garage, or other parking area. :evil2:

This is one where I would err on the side of caution. About the only way I would carry at the track is if I had clarification from the local PD that I would be dealing with if something happened.

If there are cash prizes, including a point system that pays cash prizes at the end of the season, I would consider it a professional sporting event.

But if they are paid by the prize fund then for our purposes, it is a professional sporting event.

Lot's of fun if you're into horse racing. I hadn't been in over 20 years since going to the Pocono Downs back in the 80's.
