STAR-TELEGRAM STAFF WRITER
FOREST HILLA store clerk who fatally shot a man Wednesday evening told police officers that the man had tried to rob him at gunpoint, interim Police Chief David Miller said.

The 23-year-old clerk, who was not identified Wednesday night, told police that two men broke into Fabulous Urban & Sportswear in the 3300 block of Mansfield Highway after the store closed, Miller said.

The clerk said he shot one of the intruders in the chest and leg with a gun kept at the store before calling police about 9:20 p.m., Miller said.

The man was pronounced dead at John Peter Smith Hospital in Fort Worth at 9:56 p.m., Miller said.

The store's manager, who identified himself as the clerk's uncle, said the robbers' weapons appeared to be Uzis. The man who was shot put his weapon to the clerk's head, he said.

"He did what he had to do," said the manager, who declined to give his name. "It was self-defense."

The manager said he moved to the area because of Hurricane Katrina. Since then, the store has been broken into at least four times, but this was the first armed robbery, he said.

Police were questioning the clerk late Wednesday and had not decided whether to charge him, Miller said.

The second robber was arrested, he said.

Sounds like a solid case of self-defense, but I heard on the radio that police were still considering sending to the grand jury.

To charge him? With what? A medal of bravery? :razz:
Yeah, I know there is the potential of having charges filed, but if the facts are as stated (who knows :roll:), he deserves a pat on the back and a good firm handshake for a job well done.
He took a huge risk in pulling a gun when he already had one pointed at him, but I'd be willing to bet that we soon find out that the "Uzi" wasn't even real.

That would be like pulling a plastic unloaded BBGun that looked real enough at an person and that person has a heart attack because of it. The person could still be charged for Murder cause it never would have happen had he not been pointed the gun in the first place.

I have no sympathy for a BG that dies in act of a crime by the victims they tried to take advantage of.:evil: And I have even less for the Family members that try to come back and sue for it. :banghead:

I was simply pointing out that the use of a toy can still make you just as dead when used to commit a crime. Stupid law breakers.

I think he was agreeing with you.

I wish I knew the statute (or whatever it's called), but I think to some degree it does not matter if a gun's loaded or not, or if it's a toy or not, it's still breakin' the law

oh yea
when I was learning to play guitar around 1980 we learned alot of the old priest songs, and Iron Maiden, etc..
god, we were loud and annoying to our parents :)

I grew up on Maiden. for whatever reason, never really got into Priest, but Maiden.... oh my.
and good ol' 'tallica! I'm pretty sure I can play at least one song off of each album on guitar. least, the albums that matter! hahha
